The service provided covers an extensive and diverse range of aspects relative to customs matters, with special incident in customs taxation, as well as in foreign trade.
Regarding the customs matters, our services includes customs compliance; planning and foreign trade operations structuring (maximization and/or implementation of customs benefits); implementation of customs regimes that offers benefits to the exporters (like Drawback); support and assistance in customs audits procedures (derived from objections in the import clearance or from inspection visits performed by the customs authority).
Regarding the foreign trade matters, our services covers the representation in the negotiation of international purchase transactions; payment mechanisms; guarantees; enjoyment of preferential customs treatment derived from bilateral and multilateral agreements, especially within the scope of the Andean Community and ALADI and the General System of Tariff Preferences.
Likewise, the services of our Area covers the representation in appeals against assessments that could be made by the customs authority regarding unlawful collection of customs duties and taxes applied in the importation of goods; administrative decisions that arrange the confiscation of goods, when these decisions are not accordant to law; as well as the assistance in non-contentious proceedings for customs tributes refund, when these are unduly or excessively paid. The services also cover the representation in appeals against the Customs Administration, the Fiscal Court and the Supreme Court, as appropriated.
Their members have participated as advisors and directors of various associations that gather foreign trade issues; are or have served as customs law professors in various universities in Lima; also, the Customs and Foreign Trade practice group of Rodrigo, Elías & Medrano Abogados are current lecturers on various academic and business forums.
