The Regulation, Telecommunications and Technology Practice Group of Rodrigo, Elías y Medrano Abogados provides advisory in all legal and regulatory matters related to such area.
Such advisory includes the issuance of opinions and specialized reports; the analysis and preparation of comments to regulatory proposals applicable to regulated companies; the design and implementation of strategies for the issuance of or amendment to rules and regulations necessary for a better market operation; and the drafting and negotiation of network interconnection and co-location contracts.
It also includes the drafting of standard form contracts with telecommunication users; general advisory regarding the regulatory framework; representation in administrative proceedings related to the awarding of concessions, authorizations, licenses and permits for the provision of services and the operation of telecommunication equipment; settlement of disputes among companies; challenging of orders and resolutions issued by OSIPTEL (the regulatory entity) and the Ministry of Transportation and Communications; as well as the handling of user claims and the compliance with free competition regulations.
The Technology section specializes in the legal aspects of electronic commerce and business, which implementation is currently under expansion in Peru.
The Law Firm's main clients include British Telecommunications, Infoductos and Telecomunicaciones S.A., Asociación de Empresas Privadas de Servicios Públicos de Telecomunicaciones (ADEPSEP), Nextel del Perú S.A., Microsoft Corp. and Oracle.
Several lawyers of this Practice Group serve as professors in the most important programs in Peru to apply for Master's Degrees and Graduate Studies Diplomas in the specialty of Public Services Law, and actively participate in specialized local institutions, such as the telecommunications committee of the American Chamber of Commerce and Instituto de Derecho de Servicios Públicos - IDESER, as well as in international events organized by the International Bar Association, Interlaw and APEC.
