CLOSED SEASON AND AUTHORIZATIONS

I. Authorization of transfer of public funds to Peruvian Administration of Fishery Health (SANIPES) to perform activities

Pursuant to Ministerial Order No. Nº 367-2019-PRODUCE published in the Official Gazette “El Peruano” on September 4, 2019, it is set forth to authorize the transfer of public funds of the Executing Unit 001: Ministry of Production to SANIPES up to the sum amounting to S/900,350.00 (NINE HUNDRED THOUSAND THREE HUNDRED FIFTY AND 00/100 SOLES). This transfer is charged against collected resources for Rights of Fishing under Financing Source “Directly Collected Resources” to perform the following activities: “Determination of prevalence and genotype Infectious Pancreatic Necrosis Virus (IPNV) in rainbow trout (Oncorhynchus mykiss) in Peru”.

II. Establishing a closed season for breeding of hake resource in coastline

Pursuant Ministerial Order No. 369-2019-PRODUCE published in the Official Gazette “El Peruano” on September 4, 2019, it is set forth to establish the closed season for breeding of “Peruvian hake” (Merluccius gayi peruanus) in maritime zone between 04°00’S and 07°00’S from the Peruvian maritime domain. Therefore, it is prohibited the fishing of hake resource as of 00:00 hours, September 9, 2019. Processing must be carried out within 48 hours upon commencement of closed season for breeding. Trading must be carried out provided that there are authentic documents as a proof duly dated evidencing that the product has been processed before the date of prohibition.

III. Establishing a closed season for breeding of silverside resource in the Peruvian coastline for year 2019

Pursuant to Ministerial Order No. 385-2019-PRODUCE published in the Official Gazette “El Peruano” on September 20, 2019, it is set forth to establish the closed season for breeding of Chilean silverside (Odontesthes regia) in the Peruvian coastline for year 2019 as of 00:00 hours of the second calendar day upon publication of this Ministerial Resolution. Therefore, it is prohibited all fishing activities of this species, as well as its storage, trading and carriage; unless having authentic documents as a proof duly dated evidencing that such resource has been caught before the date of prohibition. Upon a report by the Marine Institute of Peru (IMARPE), the end of this closed season for breeding shall be provided for by the pertinent Ministerial Order.

IV. Authorization of transfer of public funds to Peruvian Fisheries Development Fund (FONDEPES) in order to finance credits to support artisanal aquaculture and fishing

Pursuant to Ministerial Order No. 390-2019-PRODUCE published in the Official Gazette “El Peruano” on September 22, 2019, it is set forth to authorize a transfer of public funds charged against the 2019 Institutional Budget of the Budgetary Public Entity 038: Ministry of Production, Executing Unit 001: Ministry of Production through the “Directly Collected Resources” financing source to the Budgetary Public Entity 059: Peruvian Fisheries Development Fund (FONDEPES) up to the sum amounting to S/4’250,000.00 (FOUR MILLION TWO HUNDRED FIFTY THOUSAND AND 00/100 SOLES). This transfer aims to finance 238 credits to be granted for artisanal aquaculture and fisheries support.

V. Authorizing IMARPE to execute exploratory fishery of punctuated snake-eel resource

Pursuant to Ministerial Order No. 402-2019-PRODUCE published in the Official Gazette “El Peruano” on September 28, 2019, it is set forth to authorize IMARPE to execute an Exploratory Fishery of the punctuated snake-eel (Ophichthus remiger) resource as per the following details: Previous Acts from November 1 to 5, 2019; Exploratory Fishery from November 6 to 11, 2019; and Later Acts from November 12 to 21, 2019.

GENERAL REGULATIONS

I. Amendment to catch limit of jack meckerel resource being referred to in the Ministerial Orders No. 015-2019-PRODUCE and 105-2019-PRODUCE, whereby the resumption of large-scale fishing activities are authorized and other provisions are set forth

Pursuant to Ministerial Order No. 386-2019-PRODUCE published in the Official Gazette “El Peruano” on September 20, 2019, it is set forth to amend the first paragraph of Section 1 of the Ministerial Order No. 015-2019-PRODUCE, amended by Ministerial Order No. 105-2019-PRODUCE, to read as follows: “Section 1. The catch limit of Chilean jack mackerel (Trachurus murphyi) resource is set at 138,000 tons, and chub mackerel (Scomber japonicus peruanus) resource is set at 135,000 tons. These catch limits hereby are applicable to fishing activities performed by any type of fleet corresponding to year 2019. Such quota may be modified based on biological and/or environmental factors being estimated by the Marine Institute of Peru (IMARPE), as well as the evidence of a higher availability of Chilean jack mackerel and chub mackerel resources, for which a recommendation with pertinent measures shall be addressed to the Ministry of Production (…)”.

II. Providing the publication of the bill of the “Supreme Executive Order amending the Regulation of the General Aquaculture Act, passed by Supreme Executive Order No. 003-2016-PRODUCE” and its Preambles on the Ministry website

Pursuant to the Ministerial Order No. 392-2019- PRODUCE in the Official Gazette “El Peruano” published on September 22, 2019, it is set forth to publish the bill of the “Supreme Executive Order amending the Regulation of the General Aquaculture Act, passed by Supreme Executive Oder No. 003-2016-PRODUCE” and its pertinent Preambles on the Ministry of Production website (www.gob.pe/produce) in order to receive comments and/or contributions from citizens within a 10-calendar day term from September 23, 2019.

III. Approval of Peruvian Technical Standards of aquaculture, Andean grains, cosmetics, information technology and biological evaluation of medical devices

Pursuant of Director’s Resolution No. 017-2019-inacal/dn published in the Official Gazette “El Peruano” on September 23, 2019, it is set forth the following Peruvian Technical Standards (NTP) as per this Resolution basis, by virtue of the procedure provided for in Act No. 30224:

IV. Providing the publication of the bill of the “Ministerial Order approving the Guidelines on Quota Allocation of Chilean jack mackerel (Trachurus murphy) in the High Seas granted by the South Pacific Regional Fisheries Management Organisation to the Peruvian Government” on the Ministry website

Pursuant to Ministerial Order No. 396-2019-produce published in the Official Gazette “El Peruano” on September 24, 2019, it is set forth to publish the bill of the “Ministerial Order approving the Guidelines on Quota Allocation of Chilean jack mackerel (Trachurus murphy) in the High Seas granted by the South Pacific Regional Fisheries Management Organisation to the Peruvian Government”, as well as the pertinent Guidelines, on the Ministry of Production website (www.gob.pe/produce) in order to receive comments and/or contributions from citizens within a 5-business day term from September 25, 2019

V. Providing the publication of the bill of the “Supreme Executive Order amending the Discard and/or Fish Waste Processing Regulation approved by Supreme Executive Order No. 005-2011-PRODUCE” and its Preambles on the Ministry website

Pursuant to Ministerial Order No. 398-2019-produce published in the Official Gazette “El Peruano” on September 24, 2019, it is set forth to publish the bill of the Supreme Executive Order amending the Discard and/or Fish Waste Processing Regulation approved by Supreme Executive Order No. 005-2011-PRODUCE” and its Preambles on the Ministry of Production website (www.gob.pe/produce) in order to receive comments and/or contributions from citizens within a 15-calendar day term from September 25, 2019.

APPOINTMENTS

I. Appointment of Head of the Budget Unit of the Planning and Budget Office, as well as Chief of the Fishery and Aquaculture Permit, Authorization and Certification Division of the Peruvian Administration of Fishery Health (SANIPES)

Pursuant to Administrator’s Order No. 075-2019-SANIPES/PE published in the Official Gazette “El Peruano” on September 3, 2019, it is set forth to appoint Omar Percy CAMPOS LÓPEZ REYNA as Head of the Budget Unit, Planning and Budget Office, SANIPES, as provided for by the Temporary Assignment of Personnel Table (Temporary CAP) as a Top Manager under the discretionary appointment and removal Public Entity system, as well as Patricia Elizabeth WHITTEMBURY TALLEDO as Chief of the Fishery and Aquaculture Permit, Authorization and Certification Division, SANIPES, as provided for by the Temporary Assignment of Personnel Table (Temporary CAP) as a confidential position of the Entity.

II. Appointment of Head of the General Division of Aquaculture Technical Training and Development of the Peruvian Fisheries Development Fund (FONDEPES)

Pursuant to Director’s Resolution No. 123-2019-FONDEPES/J published in the Official Gazette “El Peruano” on September 3, 2019, it is set forth to appoint Carlos Segundo CALDERÓN DEZA as Head of the General Division of Aquaculture Technical Training and Development, FONDEPES.

 III. Appointment of Head of the Executing Unit 003: “Promotion of Direct Human Consumption of Fish – Let’s Eat Fish”

Pursuant to Ministerial Order No. 375-2019-PRODUCE published in the Official Gazette “El Peruano” on September 11, 2019, it is set forth to appoint Félix Fabián PUENTE DE LA VEGA CHUMBE as Head of the Executing Unit 003: “Promotion of Direct Human Consumption of Fish – Let’s Eat Fish”.
