List of MTC procedures that are not subject to the suspension of deadlines is approved
On May 24, 2020, Ministerial Resolution No. 0283-2020-MTC/01 was published in the Official Gazette “El Peruano”, which approved the list of procedures of the Ministry of Transport and Communications (“MTC”) that they are not subject to the suspension of deadlines established by the Emergency Decrees No. 026-2020 and No. 029-2020, and their corresponding extensions.
Specifically, 79 procedures, included in Annexes I and II to that resolution, are exempt from the aforementioned suspensions. With regard to the Vice-ministerial Office of Transport (VMC) and the National Telecommunications Program (PRONATEL), the following have been included: (i) 13 procedures regulated in the Single Text of Administrative Procedures (“TUPA”) of the MTC; and (ii) seven other procedures, related to environmental aspects.
On the other hand, regarding the Vice-ministerial Office of Transport (VMT) and the Special Project for National Transport Infrastructure (PROVIAS Nacional), the following have been included: (i) 25 procedures included in the TUPA; (ii) 18 procedures that are not foreseen in the TUPA; and (iii) 16 other procedures. These procedures may be processed through the TUPA Digital System and the Virtual Parties Bureau of the MTC, as well as through the Single Window for Foreign Trade (VUCE), as appropriate. The notification of the administrative actions issued in the framework of these procedures may be carried out by electronic means enabled by the MTC, with the prior express authorization of the applicant, pursuant to article 20.4 of the Single Ordered Text of the General Administrative Procedure Act, approved by Supreme Decree No. 004-2019-JUS.
