REGULATIONS FOR THE LAW THAT CREATES THE URBAN TRANSPORT AUTHORITY FOR LIMA AND CALLAO (ATU) ARE APPROVED

On March 8, 2019, Executive Order 005-2019-MTC was published in El Peruano Official Gazette, where the Regulations for the Law 30900, Law that creates the Urban Transport Authority for Lima and Callao (ATU) are approved.

Below are the main updates to this legal provision:

– It is specified that the scope of application includes operators, drivers and users of the Integrated Transport System (SIT), as well as operators of supplementary services within the territory of competence of the ATU.

– The principles that govern the SIT include environmental sustainability, integration, efficacy and efficiency, among others.

– The regulation establishes that the ATU plans, regulates, supervises, administrates and manages the matters regarding the SIT, services that are supplementary to the SIT, infrastructure that is supplementary to the SIT, single collection system, among others.

– Regarding the regulatory and supervising roles, the ATU will be in charge of approving regulations, rules and other provisions to regulate the service of transportation of passengers and will ensure compliance with the regulations it issues, respectively.

– On the other hand, through the management role, it will be in charge of granting operating licenses and necessary permits for the operation of urban transportation.

– With the role of administration and penalization, the ATU will verify non-compliance with the regulations of the sector, will proceed to initiate the pertinent penalizing procedures, and will exercise coercive powers.

– Furthermore, the ATU will have a role regarding public and/or private investment and it will be in charge of promoting, formulating, structuring and executing processes for promotion of public and/or private investment in accordance with applicable regulations.

– The provision explains the different types of services in the Integrated Transport System and Single Collection System and the different plans that will direct urban transportation policies.

– Finally, a term of ninety (90) days is established to approve the regulations that regulate the land transportation service and the SIT integration regulations and it is stipulated that until they are published, the rules of the Municipalities in charge and of the Autonomous Electric Train Authority (AATE) will apply.
