OSINERGMIN’s Electronic Notification Regulation, draft amendment to PR-21 and extend deadline for submission of comments are adopted

On Friday, January 15, 2021, Resolution OSINERGMIN N° 003-2021-OS-CD was published in the Official Gazette “El Peruano”, adopting the Regulations of the OSINERGMIN’s Electronic Notification System (“Regulations“), which aims to establish the necessary provisions for the implementation of mandatory electronic notification in OSINERGMIN through the Electronic Notification System (SNE) in order to provide for greater speed, efficiency and safety to be reported by OSINERGMIN.

According to the Regulation, the notification made through the SNE is exclusive of any other means of notification. In addition, the computation of deadlines for the corresponding actions begins the following working day of the notification in the electronic box. For such purposes, agents not yet registered in the SNE must register in the SNE through the institutional portal at the following Enlace, otherwise OSINERGMIN shall register ex officio.

On the other hand, on Friday, January 15, 2021, OSINERGMIN Resolution N° 003-2021-OS/CD was also published, providing for the publication of the Draft Resolution adopting the amendment of COES Technical Procedure N° 21 “Rotating Reserve for Primary Frequency Regulation” (“PR-21 Draft”), a regulation that would amend the Default Fee Settlement formula and incentive to comply with the Primary Frequency Regulation (RPF) service.

Opinions, suggestions and comments may be submitted until January 30, 2021 to the Tariff Regulation Management of OSINERGMIN through the following means: (i) electronic window (which may be accessed through the following Enlace); (ii) physical parts desk, in case this is enabled; or (iii) to the following email: PRCOES@osinergmin.gob.pe.

Finally, by means of Resolution No. 002-2021-OS/CD, OSINERGMIN extended until January 28, 2021 the deadline granted for the reception of opinions and/or suggestions to the draft resolution amending the regulation “Manual of Procedures, Formats and Means for the Calculation of the Coincident Power Balance Factor at Peak Hour (FBP)”, published by means of Resolution No. 219-2020-OS/CD.
