CLOSED FISHING SEASON AND AUTHORIZATIONS

I. Deadlines for the exploratory fishing referred to in R.M. No. 317-2019-PRODUCE are amended

Through Ministerial Resolution No. 204-2020-PRODUCE, published in the Official Gazette “El Peruano”, on July 9, 2020, the number 1.2 of article 1 of Ministerial Resolution No. 317-2019- PRODUCE is amended, which is written with the following text: “1.2 The Exploratory Fishing authorized in the preceding number shall be carried out from 00:00 on the day following the publication of this Ministerial Resolution, ending on March 23, 2021”.

II. Maximum Total Catch Limit for Direct Human Consumption (LMTC-CHD) of the anchovy resource is established for the year 2020

Through Ministerial Resolution No. 206-2020-PRODUCE, published in the Official Gazette “El Peruano”, on July 14, 2020, the Maximum Total Catch Limit for Direct Human Consumption (LMTC-CHD) of the anchovy resource is established for the year 2020 at one hundred and fifty thousand (150,000) tons, corresponding to the entire coastline, in accordance with the provisions of article 9 of the Regulations for the Fishing Regulation of the Anchovy Resource for Direct Human Consumption, adopted by Supreme Decree No. 005-2017-PRODUCE and amending, which shall be used exclusively for direct human consumption. The LMTC-CHD of the anchovy resource may be amended in accordance with the ongoing monitoring of the anchovy fishery by the Institute of the Peruvian Sea-IMARPE, in order to ensure supplies for the fisheries processing for direct human consumption, notwithstanding this, the completion date of extractive activities shall be once the aforementioned LMTC-CHD has ended, or failing that, when IMARPE recommends it for environmental or biological circumstances.

III. Conservation measures to be applied in the tuna fishery in compliance with the Resolutions of the Inter-American Tropical Tuna Commission-IATTC are established, and other provisions are issued.

Through Ministerial Resolution No. 207-2020-PRODUCE, published in the Official Gazette “El Peruano”, on July 14, 2020, conservation measures to be applied in the tuna fishery in compliance with the Resolutions of the Inter-American Tuna Commission Tropical-IATTC are established, notwithstanding to the provisions contained in the Tuna Fishing Regulation, adopted by Supreme Decree No. 032-2003-PRODUCE and amendments, and other applicable provisions, which shall be complied with by registered national fishing vessels with the Inter-American Tropical Tuna Commission-IATTC. In addition, the extraction of tuna and tuna-like species established in number 3.1 of article 3 of the Tuna Fishing Regulations, adopted by Supreme Decree No. 032-2003-PRODUCE and amendments, carried out by IATTC class 4 to 6 capacity purse seine vessels (larger than 182 tons of carrying capacity) flying the Peruvian flag, in the Eastern Pacific Ocean (EPO) from July 29 to October 08, 2020.

IV. Granting of subsidies is authorized in favor of Executing Entities (private legal entities) that carry out Subprojects for Innovation in Fisheries and Aquaculture, derived from the PNIPA Competitions 2017-2018 and 2018-2019

Through Board Resolution No. 017-2020-PRODUCE-PNIPA-DE, published in the Official Gazette “El Peruano”, on July 15, 2020, the granting of subsidies is authorized in favor of the Executing Entities (private legal entities) that carry out Subprojects for Innovation in Fisheries and Aquaculture derived from the PNIPA Competitions 2017-2018 and 2018-2019, in the following categories: Applied Research and Technological Development (SIADE), Adaptive Research (SIA), Extension Service (SEREX), and Strengthening of Capabilities in Services of I+D+i (SFOCA), in Fisheries and Aquaculture, respectively, up to the sum of S/.1,568,187.43 (One million five hundred sixty-eight thousand one hundred eighty-seven with 43/100 Soles), corresponding to the amount of S/.741,522.10 (Seven hundred and forty-one thousand five hundred and twenty-two with 10/100 Soles) by source of funding Directly Collected Resources (RDR), and the amount of S/.826,665.33 (Eight hundred and twenty-six thousand, six hundred and sixty-five with 33/100 Soles) by source of funding Resources from Official Credit Operations (ROOC), within the framework of Loan Contract No. 8692-PE and under the provisions of Emergency Decree No. 014-2019, which adopts the Budget of the Public Sector for Fiscal Year 2020.

V. The National Fisheries Health Agency (SANIPES) is authorized to develop a pilot project to optimize health criteria for the processing of fishery products for direct human consumption

Through Board Resolution No. 012-2020-PRODUCE, published in the Official Gazette “El Peruano”, on July 25, 2020, the National Fisheries Health Agency (SANIPES) is authorized to develop a pilot project to optimize health criteria for the processing of fishery products for direct human consumption, for export purposes, contributing to the economic reactivation of the country. The duration of the pilot project shall not exceed twelve months after SANIPES implements the pilot project. Holders of operating licenses for industrial fishery processing plants for direct human consumption who wish to participate in the pilot project must express their interest within thirty calendar days from the date of entry into force of this Supreme Decree.

VI. The beginning of the First Fishing Season of the anchovy and white anchovy resource is authorized, in the maritime area between 16°00’SL and the southern end of the Peruvian maritime domain, corresponding to the period August – December 2020

Through Board Resolution No. 249-2020-PRODUCE, published in the Official Gazette “El Peruano” on July 28, 2020, the beginning of the First Fishing Season of the anchovy (Engraulis ringens) and white anchovy (Anchoa nasus) resource is authorized, in the maritime area between 16°00’SL and the southern end of the Peruvian maritime domain, corresponding to the period August – December 2020. The beginning of the First Fishing Season shall be effective from 00:00 hours on August 01 2020, being the completion date, once the Maximum Total Allowable Catch Limit for the Southern Zone (LMTCP-South) has been reached, or failing that, it may not exceed December 31, 2020. The completion date of The First Fishing Season 2020 of the Southern Zone may be amended according to the biological-environmental conditions, following a report by IMARPE, through the issuance of the respective Ministerial Resolution. It also indicates that the Maximum Total Allowable Catch Limit for the Southern Zone (LMTCP-South) of the anchovy (Engraulis ringens) and white anchovy (Anchoa nasus) resource for indirect human consumption, corresponding to the Southern First Fishing Season 2020, is four hundred thirty-five thousand (435,000) tons.

GENERAL REGULATIONS

I. “Technical Sanitary Procedure for the management of notifications, complaints from parties, food incidents and health alerts on ​​fisheries and aquaculture safety” is adopted

Through Executive Presidency Resolution No. 049-2020-SANIPES/PE, published in the Official Gazette “El Peruano”, on July 22, 2020, the “Technical Sanitary Procedure for the management of notifications, complaints from parties, food incidents and health alerts on fisheries and aquaculture safety” is adopted.

II. “Technical Sanitary Procedure for Sampling and Dispatch to the Laboratory of Hydrobiological Resources for the Diagnosis of Diseases” is adopted

Through Executive Presidency Resolution No. 050-2020-SANIPES/PE, published in the Official Gazette “El Peruano”, on July 22, 2020, the “Technical Sanitary Procedure for Sampling and Dispatch to the Laboratory of Hydrobiological Resources for Diagnosis of Diseases” is adopted.

III. The publication of the draft “Ministerial Resolution establishing the authorized weighing instruments and their technical requirements for the weighing of hydrobiological resources, waste, discards and raw material not considered for processing by selection of size, weight or quality from the anchovy resource, in industrial fishery product processing plants for direct human consumption, residual flour plants and re-use plants, processing plants for marine macroalgae hydrobiological resource and artisan plants for direct human consumption ” is provided

Through Ministerial Resolution No. 244-2020-PRODUCE, published in the Official Gazette “El Peruano”, on July 25, 2020, the publication of the draft “Ministerial Resolution establishing the authorized weighing instruments and their technical requirements for the weighing of hydrobiological resources, waste, discards and raw material not considered for processing by selection of size, weight or quality from the anchovy resource, in industrial fishery product processing plants for direct human consumption, residual flour plants and re-use plants, processing plants for marine macroalgae hydrobiological resource and artisan plants for direct human consumption ” is provided, on the Institutional Website of the Ministry of Production (www.gob.pe/produce), in order to receive opinions, comments and/or suggestions from citizens, for a period of ten (10) calendar days, counted from July 26, 2020.

APPOINTMENTS

I. Head of the Supply Unit of the National Fisheries Health Agency – SANIPES is appointed

Through Executive Presidency Resolution No. 044-2020-SANIPES/PE, published in the Official Gazette “El Peruano”, on July 1, 2020, Mrs. Gissela Zapata Flores is appointed as head of the Agency’s Supply Unit National Fisheries Health – SANIPES, provided in the table for Assignment of Provisional Personnel (Provisional CAP), as a trust position of the Entity.

II. The Reorganization of Positions of the Table for the Assignment of Provisional Personnel of the National Fisheries Development Fund is adopted

Through General Management Resolution No. 031-2020-FONDEPES/GG, published in the Official Gazette “El Peruano”, on July 7, 2020, the Reorganization of Positions of the Table for the Assignment of Provisional Personnel of the National Fisheries Development Fund is adopted, which is annexed hereto forms an integral part of this Resolution.

III. Responsible for the development and updating of the Standard Transparency Website of the National Fisheries Development Fund is appointed

Through Administrative Resolution No. 063-2020-FONDEPES/J, published in the Official Gazette “El Peruano, on July 8, 2020, the Coordinator of Information and Communication Technology of the General Office of Administration is appointed as Responsible for the development and updating of the Standard Transparency Website of the National Fisheries Development Fund, in accordance with the provisions of Supreme Decree No. 021-2019-JUS and Supreme Decree No. 072-2003-PCM.

IV. Supply Coordinator of the General Administration Office of the National Fisheries Development Fund is appointed

Through Administrative Resolution No. 065-2020-FONDEPES/J, published in the Official Gazette “El Peruano”, on July 8, 2020, Luis Aquiles Fernández Araujo is appointed as Supply Coordinator of the General Administration Office of the National Fisheries Development Fund.

V. A temporary Multi-Sectoral Working Group is formed in order to propose actions leading to the implementation of the “Convention for the Conservation and Management of Fishery Resources in the High Seas of the South Pacific Ocean” and other provisions are adopted

Through Ministerial Resolution No. 182-2020-PRODUCE, published in the Official Gazette “El Peruano”, on June 27, 2020, the temporary Multi-Sectoral Working Group, under the Ministry of Production, is formed in order to propose actions leading to the implementation of the “Convention for the Conservation and Management of Fishery Resources in the High Seas of the South Pacific Ocean”, as well as the conservation and management measures agreements adopted by The South Pacific Regional Fisheries Management Organisation (SPRFMO).
