CLOSED FISHING SEASON AND AUTHORIZATIONS

I. The Institute of the Peruvian Sea – IMARPE is authorized to carry out an Exploratory Fishing of the horse mackerel resource in order to determine the by-catch of the mackerel resource

Through Ministerial Resolution No. 186-2020-PRODUCE, published in the Official Gazette “El Peruano”, on June 29, 2020, the Institute of the Peruvian Sea – IMARPE is authorized to carry out an Exploratory Fishing of the horse mackerel resource (Trachurus murphyi) in order to determine the by-catch of the mackerel resource (Scomber japonicus peruanus), with the participation of artisanal vessels from 00:00 hours from June 2 to December 31 of the current year, or failing that when it is reached the catch limit established in Ministerial Resolution No. 025-2020-PRODUCE, expanded by Ministerial Resolution No. 123-2020-PRODUCE, or when IMARPE recommends it for reasons of conservation of those resources.

II Provisional Fishing Regime for Hake Resource is established from July 2020 to June 2021 in the maritime area

Through Ministerial Resolution No. 188-2020-PRODUCE, published in the Official Gazette “El Peruano” on June 30, 2020, the Provisional Regime of Fishing for the Hake Resource (Merluccius gayi peruanus) is established from July 2020 to June 2021, in the framework which authorizes the carrying out of extractive activities of the aforementioned resource from 00:00 from July 01, 2020 to June 30, 2021, in the maritime area from the northern end of the Peruvian maritime domain and 07°00′ South Latitude.

In turn, the Maximum Allowable Total Catch Limit (LMCTP) for the Provisional Fisheries Regime for the Hake Resource is established at fifty thousand eight hundred and twenty-three (50,823) tons. III. Extraction of the red hedgehog resource is authorized in the San Juan de Marcona coastal area, Ica Region Through Ministerial Resolution No. 189-2020-PRODUCE, published in the Official Gazette “El Peruano”, on June 30, 2020, the extraction of the red hedgehog resource (Loxechinus albus) is authorized in the area between 14.9541°S, 75.5084°W; 15.4583°S, 75.0238°W in the San Juan de Marcona coastal area, Ica Region from July 1, 2020 to June 30, 2021.

 

GENERAL REGULATIONS

 I. The publication of the draft of “Supreme Decree amending the Health Standard for Live Bivalve Molluscs, adopted by Supreme Decree No. 07-2004-PRODUCE”, as well as its Explanatory Statement on the Institutional Website of the Ministry are provided  Through Ministerial Resolution No. 169-2020-PRODUCE, published in the Official Gazette “El Peruano”, on June 4, 2020, the publication of the draft of “Supreme Decree amending the Health Standard for Live Bivalve Molluscs, adopted by Supreme Decree No. 07-2004-PRODUCE”, as well as its Explanatory Statement on the Institutional Website of the Ministry of Production (www.gob.pe/produce) are provided, in order to receive opinions, comments and/or suggestions from citizens, for a period of ten (10) calendar days, counted from June 5, 2020.

II. The Ministerial Resolution R.M. No. 449-2003-PRODUCE is amended on the prohibition of the physical transfer or change of location of industrial fishing establishments for the development of indirect human consumption activities towards the ports or bays and zones or areas of influence of Paita, Sechura, Chimbote and Pisco (Paracas ) Through Ministerial Resolution No. 177-2020-PRODUCE, published in the Official Gazette “El Peruano” on June 14, 2020, Article 2 of Ministerial Resolution No. 449-2003-PRODUCE is amended as follows: “Article 2.- The physical transfer or change of location of industrial fishing establishments for the development of activities of indirect human consumption to the ports or bays and zones or areas of influence of Paita, Sechura, Chimbote and Pisco (Paracas) is prohibited. The physical transfer or change of location to the non-prohibited areas or zones is carried out after approval of the corresponding environmental management instrument and in accordance with the provisions of Decree Law No. 25977, General Fisheries Act, its Regulations adopted by Supreme Decree No. 012-2001-PE; the Environmental Management Regulations of the Fisheries and Aquaculture Subsectors, adopted by Supreme Decree No. 012-2019-PRODUCE; Supreme Decree No. 010-2018-MINAM adopting the Maximum Allowable Limits for effluents from industrial fishing establishments for direct and indirect human consumption; Supreme Decree No. 011-2009-MINAM that adopts Maximum Allowable Limits for emissions from the Fishmeal and Fish Oil Industry and Meal from Hydrobiological Residues, and other legal provisions that may be applicable”.

III. The publication of the draft of “Supreme Decree amending Supreme Decree No. 016-2016-PRODUCE is provided and measures to authorize operations in Peruvian ports and shipyards of foreign flag vessels that carry out fishing activities of highly migratory, straddling or transboundary hydrobiological resources in high seas are established” Through Ministerial Resolution No. 179-2020-PRODUCE, published in the Official Gazette “El Peruano”, on June 17, 2020, the publication of the draft of “Supreme Decree amending the “Supreme Decree No. 016-2016-PRODUCE is provided and measures to authorize operations in Peruvian ports and shipyards of foreign-flagged vessels that carry out fishing activities of highly migratory, straddling or transboundary hydrobiological resources in high seas as well as its Explanatory Statement on the Institutional Website of the Ministry of Production (www.gob.pe/produce) are established”, in order to receive comments and/or suggestions from citizens for a period of five (05) working days, counted from June 17 of the current year.

IV. The publication of the draft of ” Technical Health Procedure for the Sampling and Sending to the Laboratory of Hydrobiological Resources for the Diagnosis of Diseases” is provided Through Executive Presidency Resolution No. 039-2020-SANIPES/PE, published in the Official Gazette “El Peruano”, on June 19, 2020, the publication of the draft “Technical Health Procedure for the Sampling and Sending to the Laboratory of Hydrobiological Resources for the Diagnosis of Diseases” is provided on the Institutional Website of the National Fisheries Health Agency – SANIPES (www.sanipes.gob.pe), in order to receive comments and/or suggestions from the public within ten (10 ) working days, counted from June 20 of the current year. 

V. The publication of the draft of “Technical Health Procedure for the management of notifications, complaints from parties, food incidents and health alerts in the field of fisheries and aquaculture safety” is provided Through Executive Presidency Resolution No. 040-2020-SANIPES/PE, published in the Official Gazette “El Peruano”, on June 19, 2020, the publication of the draft of “Technical Health Procedure for the management of notifications, complaints from parties, food incidents and health alerts in the field of fisheries and aquaculture safety” is provided on the Institutional Website of the National Fisheries Health Agency-SANIPES (www.sanipes.gob.pe), in order to receive comments and/or suggestions from citizens for a period of five (05) calendar days, counted from 20 June of the current year.

VI. The publication of the draft of “Supreme Decree amending the Regulation of the General Aquaculture Act, adopted by Supreme Decree No. 003-2016-PRODUCE and the Regulation of Control and Sanction of Fisheries and Aquaculture Activities, adopted by Supreme Decree No. 017-2017-PRODUCE is provided” Through Ministerial Resolution No. 180-2020-PRODUCE, published in the Official Gazette “El Peruano”, on June 23, 2020, the publication of the draft of “Supreme Decree amending the Regulation of the General Aquaculture Act, adopted by Decree Supreme No. 003-2016-PRODUCE and the Regulation of Control and Sanction of Fisheries and Aquaculture Activities, adopted by Supreme Decree No. 017-2017-PRODUCE” as well as its Explanatory Statement is provided on the Institutional Website of the Ministry of the Production (www.gob.pe/produce), in order to receive comments and/or suggestions from citizens for a period of fifteen (15) working days, counted from June 23 of the current year.

VII. The publication of the draft of “Supreme Decree adopting the provision of Services Provided Exclusively by the National Fisheries Health Agency-SANIPES, linked to the export of hydrobiological resources and products, and feed for use in aquaculture”, as well as its Explanatory Statement is provided on the Institutional Website of the Ministry of Production Through Ministerial Resolution No. 181-2020-PRODUCE, published in the Official Gazette “El Peruano”, on June 24, 2020, the publication of the draft of “Supreme Decree adopting the provision of Services Provided Exclusively by the National Fisheries Health Agency-SANIPES, linked to the export of hydrobiological resources and products, and feed for use in aquaculture”, as well as its Explanatory Statement is provided on the Institutional Website of the Ministry of Production ((www.gob.pe/produce), in order to receive comments and/or suggestions from citizens for a period of five (05) calendar days, counted from June 24 of the current year.

VIII. The publication of the draft of “Ministerial Resolution establishing the authorized weighing instruments and their technical requirements for weighing anchovy and white anchovy hydrobiological resources in processing plants for fishery products for indirect human consumption with a high protein content” is provided on the Institutional Website of the Ministry Through Ministerial Resolution No. 183-2020-PRODUCE, published in the Official Gazette “El Peruano”, on June 27, 2020, the publication of the draft of “Ministerial Resolution establishing the authorized weighing instruments and their technical requirements for weighing anchovy and white anchovy hydrobiological resources in processing plants for fishery products for indirect human consumption with a high protein content” is provided on the Institutional Website of the Ministry of Production ((www.gob.pe/produce), in order to receive comments and/or suggestions from citizens for a period of ten (10) working days, counted from June 28, 2020. 

IX. The publication of the draft of “Supreme Decree authorizing the National Fisheries Health Agency-SANIPES to develop a pilot draft to optimize health criteria for the processing of fishery products for direct human consumption” is provided Through Ministerial Resolution No. 187-2020-PRODUCE, published in the Official Gazette “El Peruano”, on June 29, 2020, the publication of the draft of “Supreme Decree authorizing the National Fisheries Health Agency-SANIPES to develop a pilot draft to optimize health criteria for the processing of fishery products for direct human consumption”, as well as its Explanatory Statement is provided on the Institutional Website of the Ministry of Production (www.gob.pe/produce), in order to receive comments and/or suggestions from citizens for a period of five (05) calendar days, counted from June 29 of the current year.

 APPOINTMENTS

 I. Advisor I to the Head of the National Fund for Fisheries Development was appointed Through Administrative Resolution No. 056-2020-FONDEPES/J, published in the Official Gazette “El Peruano”, on June 2, 2020, Mr. Juan Carlos Quiroz Infantas was appointed as Advisor I to the Head of the National Fund of Fishing Development. II. A Multi-sectoral Working Group of a temporary nature is formed in order to propose actions leading to the implementation of the “Convention for the Conservation and Management of High Seas Fishery Resources of the South Pacific Ocean” and other provisions are adopted   Through Ministerial Resolution No. 182-2020-PRODUCE, published in the Official Gazette “El Peruano”, on June 27, 2020, a Multi-sectoral Working Group of a temporary nature, attached to the Ministry of Production, is formed in order to propose actions leading to the implementation of the “Convention for the Conservation and Management of High Seas Fishery Resources of the South Pacific Ocean”, as well as the conservation and management measures agreements are adopted by the South Pacific Regional Fisheries Management Organisation (SPRFMO).
