The “Draft Supreme Decree that amends the Regulation for the installation and operation of Natural Gas Vehicle (NGV) Retailing Establishments, adopted by Supreme Decree N° 006-2005-EM and issues provisions” was published 

Through Ministerial Resolution N° 029-2021-MINEM/DM, published in the Official Gazette El Peruano, on February 6, 2021, it was ordered the publication of the draft Supreme Decree that amends the Regulation for the installation and operation of Natural Gas Vehicle (NGV) Retailing Establishments, adopted by Supreme Decree N° 006-2005-EM (“NGV Regulation“) and issues provisions in this regard (“Draft“).

The Draft seeks to encourage and guarantee the permanence and continuity of the use of NGV, in accordance with the provisions of the National Energy Policy of Peru 2010-2040, adopted by Supreme Decree N° 064-2010-EM; which established as one of its objectives the development of the Natural Gas industry and its use in transport activities, and as a guideline the promotion of NGV in the transport sector to replace the use of liquid fuels derived from petroleum.

To promote the NGV market, it has been considered necessary to implement mechanisms and incentives for NGV users and traders, as well as for the other agents that are part of the NGV Refueling Control System (“System“), using resources from the Energy Social Inclusion Fund or other available financing sources.

However, prior to the implementation of such mechanisms and incentives, it shall be necessary to strengthen both the operability of the System, as well as the roles and responsibilities of its Supervisory and Administrative Board, in terms of safety and operability of the System and promotion of the use of NGV at a national level.

Therefore, the Draft proposes amendments in this sense to the Articles of the NGV Regulation that regulate the operation of the System and its governing and administration bodies; and the creation of a virtual inspection and maintenance registry of NGV/CNG/LNG cylinders, applicable to NGV retail outlets and CNG and LNG authorized agents to contribute to the safety in the commercialization of NGV.

Interested parties may submit their comments within ten (10) working days following the publication of the Draft; that is, until February 19, 2021.
