By means of Ministerial Resolution Nº 208-2023-MINEM/DM (“Resolution”), published on May 21, 2023 in the Official Gazette “El Peruano”, temporary measures of exception were issued for agents that commercialize Liquefied Petroleum Gas (“LPG”), in order to avoid affecting the normal development of the activities of commercialization and supply of bottled LPG (“LPG-E”) in the country, as a result of the light and moderate intensity swells reported in the northern, central and southern coast of the country that have been affecting the normal disembarkation of hydrocarbons in the ports of the coast.
For these purposes, the Resolution provided the following:
Exempt agents that sell LPG through an LPG Supply Plant from complying with the First Final Complementary Provision of Supreme Decree Nº 023-2021-EM, by means of which obligations were issued for LPG-E commercialization agents regarding the purchase and registration of LPG-E and LPG in bulk (“LPG-G”), among others.
All sales of LPG-G and/or LPG-E must be made through the Order Control System – SCOP.
The OSINERGMIN shall carry out the actions referred to the control systems under its responsibility, within the framework of its competences.
The temporary measures of exception came into effect from the publication of the Resolution and will remain in force for a period of up to seven (7) calendar days. However, the General Directorate of Hydrocarbons of the Ministry of Energy and Mines may extend or terminate the validity of the measures, depending on the permanence of the situation affecting the supply of hydrocarbons that motivates them.
