I. REPRODUCTIVE CLOSURE OF THE RESOURCE “RAINBOW TROUT” IN THE DEPARTMENT OF HUANCAVELICA IS ESTABLISHED
By means of Ministerial Resolution Nº 175-2023-PRODUCE, published in an extraordinary edition of the Official Gazette “El Peruano” on May 24, 2023, the reproductive ban of the resource “rainbow trout” in the high Andean water bodies of the department of Huancavelica was established.
The ban is from June 1 to August 31, 2023, prohibiting its extraction, commercialization, transport and processing, except for the resource or product from duly authorized aquaculture production centers.
II. AUTHORIZATION TO IMARPE TO CARRY OUT OPERATION EEL II.
By means of Ministerial Resolution Nº 184-2023-PRODUCE, published in an extraordinary edition of the Official Gazette “El Peruano” on May 29, 2023, the Institute of the Sea of Peru- IMARPE, was authorized to carry out Operation Eel II in the maritime area between 03”24’S and 06”30’S for a period of (7) seven calendar days from May 30 to June 5, 2023 and with the participation of (2) two small-scale vessels.
III. AUTHORIZATION TO IMARPE TO CARRY OUT AN EXPLORATORY FISHERY OF THE RED SEA URCHIN RESOURCE.
By means of Ministerial Resolution Nº 185-2023-PRODUCE, published in the Official Gazette “El Peruano” on May 30, 2023, the Institute of the Sea of Peru – IMARPE, was authorized to carry out an exploratory fishery of the red sea urchin resource with the participation of artisanal fishery vessels, in the maritime area between parallels 15°0343. 16” S 75°24’37.58” W and 15°27’54.32” S, 75°02’0.06” W, starting the day after the publication of this resolution. The quota is 73.6 tons and the exploratory fishery will last until the quota is reached or, until June 30, 2023.
IV. CATCH QUOTA OF THE GIANT SQUID OR POTA IS ESTABLISHED FOR THE PERIOD 2023
By means of Ministerial Resolution Nº 186-2023-PRODUCE, published in the Official Gazette “El Peruano” on May 30, 2023, the catch quota of the giant squid or pota resource for the year 2023 was established at 420,000 tons. The fishery of this resource will end when the quota is reached or on December 31, 2023.
GENERAL REGULATIONS
I. PROVISIONS ARE ESTABLISHED FOR ARTISANAL SHIPOWNERS UNDER DS 006-2016-PRODUCE TO OBTAIN THEIR FISHERY PERMITS
By Supreme Decree Nº 003-2023-PRODUCE, published in the Official Gazette “El Peruano” on May 13, 2023, provisions were established so that artisanal shipowners who obtained a permit under numeral 6.2 of Article 6 of Supreme Decree Nº 006-2016-PRODUCE, may apply for their fishery permit through the administrative procedure established by Supreme Decree Nº 018-2021-PCM.
II. REGULATION OF THE TAX PROVISIONS CONTAINED IN LAW Nº 31666 IS APPROVED – LAW FOR THE PROMOTION AND STRENGTHENING OF AQUACULTURE
By means of Supreme Decree Nº 092-2023-EF, published in the Official Gazette “El Peruano” on May 16, 2023, the regulations for the application of the tax benefits related to Income Tax and early recovery of the General Sales Tax, contained in Law Nº 31666 – Law for the Promotion and Strengthening of Aquaculture, were approved.
III. THE GENERAL FISHERY LAW IS AMENDED AND NEW COMMERCIAL CLASSIFICATION OF VESSELS AND PROHIBITION OF INDUSTRIAL FISHERY IN THE FIVE MILE AREA IS ESTABLISHED
Law Nº 31749, published in the Official Gazette “El Peruano” on May 20, 2023, amended Articles 20 and 33 of the General Fisheries Law – Decree Law Nº 25977.
Thus, it defined artisanal activity as that which is carried out with a predominance of manual labor and with the use of small boats or without them; small-scale activity as that which uses small boats that use mechanized fishery equipment and systems; and large-scale activity as that which uses larger fishery boats. It leaves to the Regulations the definition of the predominance of manual labor and the establishment of the technical characteristics that differentiate each of the categories.
It also established the prohibition of larger-scale extractive activities in the five-mile zone.

By Supreme Resolution Nº 009-2023-PRODUCE published in the Official Gazette “El Peruano” on May 27, 2023, Mr. Sergio Gilberto Rodríguez Soria was appointed head of the National Fisheries Development Fund – FONDEPES.
