CLOSED FISHING SEASON AND AUTHORIZATIONS

I. The Peruvian Institute of the Sea (IMARPE) obtains authorization to carry out exploratory fishing of anchovy and white anchovy in the Northern part – Center of the Peruvian Sea, using large-scale purse seine vessels

Through Ministerial Resolution N° 477-2019-PRODUCE published in the Official Gazette “El Peruano” on November 5, 2019, the Peruvian Institute of the Sea (IMARPE) was authorized to carry out exploratory fishing of Anchovy (Engraulis ringens) and white Anchovy (Anchoa nasus) in the Northern area – Center of the Peruvian Sea, using large-scale purse seine vessels, in order to update the information about the distribution of anchovy, their structure by size and the incidence of other species in that area. Exploratory fishing will be carried out from 00:00 hours on October 6 to 16, 2019, in the sea area between the far north of the Peruvian maritime domain and parallel 15º59’ S and beyond the 5-nautical mile zone from the coast.

II. The Extractive activity of the hake carried out by industrial trawlers in the Peruvian maritime domain is suspended

Through Ministerial Resolution N° 478-2019-PRODUCE published in the Official Gazette “El Peruano” on November 8, 2019, the extractive activity of the hake resource (Merluccius gayi peruanus) carried out by industrial trawlers between parallels 03 °30’S and 04°00’S of the Peruvian maritime domain is suspended for a period of seven calendar days, this will be effective from 00:00 hours on November 9, 2019.

III. The Extractive activity of the yellow tail resource for small-scale fleets concludes

Through Ministerial Resolution N° 479-2019-PRODUCE published in the Official Gazette “El Peruano” on November 11, 2019, the extractive activity of the yellow tail resource (Trachurus murphyi) for small-scale fleets is deemed to be concluded, this will be effective from 00:00 hours on November 13, 2019. In addition, the storage, trade and transport of this resource must have indubitable documentation, the date of which must demonstrate that this resource was extracted before the abovementioned date.

IV. The start of the Second Fishing Season of the anchovy and white anchovy resources in the Peruvian maritime domain is authorized and the Total Allowable Catch Limit in the North-Central area is ordered

Through Ministerial Resolution N° 483-2019-PRODUCE published in the Official Gazette “El Peruano” on November 12, 2019, the start of the Second Fishing Season of anchovy (Engraulis ringens) and white anchovy (Anchoa nasus) resources between the far north of the Peruvian maritime domain and parallel 16°00’LS is authorized from 00:00 hours on November 16, 2019, and the conclusion date will be when the authorized Total Allowable Catch Limits in the North-Central area has been reached, or otherwise when recommended by the Peruvian Institute of the Sea (IMARPE) due to environmental or biological circumstances.

In turn, the Total Allowable Catch Limit in the North-Central area of the anchovy resource (Engraulis ringens) and white anchovy (Anchoa nasus) for indirect human consumption has been established in Two Million Seven Hundred and Eighty Six Thousand (2’786,000) tons.

V. Closed reproductive season of the hydro-biological rainbow trout resource in the High Andean water bodies of the Ancash Region is ordered

Through Ministerial Resolution N° 493-2019-PRODUCE PRODUCE published in the Official Gazette “El Peruano” on November 15, 2019, the closed reproductive season of the hydro-biological rainbow trout resource (Oncorhynchus mykiss) in the High Andean water bodies of the Ancash Region is established and will become effective every year from January 1 to April 30; and any extraction activity involving this species is prohibited, as well as its trade and transport in this region; except for the resources coming from the aquiculture farms.

VI. The Extractive activity of the hake resource carried out by industrial trawlers in the Peruvian maritime domain is suspended

Through Ministerial Resolution N° 505 -2019-PRODUCE published in the Official Gazette “El Peruano” on November 21, 2019, the extractive activity of the hake resource (Merluccius gayi peruanus) carried out by industrial trawlers between parallels 03 °30’S and 04°00’S of the Peruvian maritime domain is suspended for a period of seven (7) calendar days, this will be effective from 00:00 hours on November 22, 2019.

GENERAL LEGAL FRAMEWORK

I. Section 1 of Ministerial Resolution N° 213-2019-PRODUCE is amended in relation to the fishing catch quota of giant squid for 2019

Through Ministerial Resolution N° 475-2019-PRODUCE published in the Official Gazette “El Peruano” on November 3, 2019, I.         Section 1 of Ministerial Resolution N° 213-2019-PRODUCE is amended, which now reads as follows:

Section 1.- Fishing catch quota of giant squid (Dosidicus gigas)

The fishing catch quota of giant squid (Dosidicus gigas) for 2019 has been established in Five Hundred Four Thousand (504,000) tons.

II. Ministerial Resolution N° 110-2012-PRODUCE is amended, in the excerpt whereby the General Director of Fishing Extraction and Production for Human Direct Consumption is authorized to sign Agreements.

Through Ministerial Resolution N° 482-2019-PRODUCE published in the Official Gazette “El Peruano” on November 12, 2019, section 3 of Ministerial Resolution N° 110-2012-PRODUCE is amended, which now reads as follows:

“To authorize the General Director of Artisanal Fisheries to sign Agreements according to the management agreement model for the Administration of Artisanal Fishing Infrastructures, approved by Ministerial Resolution N° 110-2012-PRODUCE.”

“In addition, the General Director of Artisanal Fisheries is also authorized to sign any addenda of the agreement renewals in the event that the selection of the Social Artisanal Fishermen Organization is still pending, under the provisions of point 4.6, paragraph B, fourth clause of the “Management Agreement for the Administration of Artisanal Fishing Infrastructures between the Ministry of Production or the Regional Government, the Fisheries Development Fund (FONDEPES) and the Social Organization of Artisanal Fishermen” approved by Ministerial Resolution N° 110-2012-PRODUCE.”

III. The publication of the draft Ministerial Resolution is ordered, which establishes the calculation factors of the fishing right per extracted ton of the eel resource

Through Ministerial Resolution N° 494-2019-PRODUCE published in the Official Gazette “El Peruano” on November 15, 2019, the publication in the Portal of the Ministry of Production (www.gob.pe/produce) of the draft Ministerial Resolution which establishes the calculation factors of the fishing right per extracted ton of the eel resource (Ophichthus remiger) is ordered so that the opinions, comments and/or suggestions from the citizens can be received for a term of twenty (20) calendar days from November 16, 2019.

IV. The publication of the draft “Supreme Decree that amends the Regulation on the General Fisheries Law, approved by Supreme Decree N° 012-2001-PE and the Regulation of the Hake Fisheries Legislation, approved by Supreme Decree N° 016-2003-PRODUCE” and the statement of reasons is ordered

Through Ministerial Resolution N° 495-2019-PRODUCE published in the Official Gazette “El Peruano” on November 15, 2019, the publication in the Portal of the Ministry of Production (https://www. gob.pe/produce) of the draft “Supreme Decree that amends the Regulation on the General Fisheries Law, approved by Supreme Decree N° 012-2001-PE and the Regulation of the Hake Fisheries Legislation, approved by Supreme Decree N° 016-2003-PRODUCE” and the statement of reasons is ordered so that the opinions, comments and/or suggestions from the citizens can be received for a period of twenty (20) calendar days, counted from November 16, 2019.

V. The Regulation on the Tuna Fisheries Legislation approved by Supreme Decree N° 032-2003-PRODUCE is amended

Through Ministerial Resolution N° 017-2019-PRODUCE published in the Official Gazette “El Peruano” on November 19, 2019, section 6 of the Tuna Fisheries Legislation approved by Supreme Decree N° 032-2003-PRODUCE is amended, and reads as follows:

“Section 6.- ACCESS SYSTEM FOR TUNA FISHING (…)

6.5. The owners of foreign flag fishing vessels can have access to tuna fishing.

6.5.1. (…)

The fishing permit granted to the foreign flag fishing vessel includes the obligation to deliver at least thirty percent (30%) of the tuna caught or the carrying capacity of the vessel during the validity term of their fishing permit and related renewals, where applicable. The deadline for compliance with this obligation is one (1) year counted from the effective date of the fishing permit or the start date of their renewals. The delivery of the hake resource is carried out by mutual agreement between the owner of the foreign flag tuna fishing vessel and the individuals or legal entities domiciled in the country. The General Department for Supervision, Control and Sanctions of the Office of the Deputy Minister of Fisheries and Aquaculture verifies compliance with the provisions of this section. (…)”   

VI. The publication of the draft “Supreme Decree that approves the Regulation on Benthic Invertebrates Fisheries Legislation, and amends Section 134 of the Regulation on General Fisheries Legislation and the Table of Sanctions of the Regulation on Control and Sanction of Fisheries and Aquaculture Activities” and their statement of reasons is ordered

Through Ministerial Resolution N° 502-2019-PRODUCE published in the Official Gazette “El Peruano” on November 20, 2019, the publication in the Portal of the Ministry of Production (www.gob.pe/produce) of the draft “Supreme Decree that approves the Regulation on Benthic Invertebrates Fisheries Legislation and amends Section 134 of the Regulation on General Fisheries Legislation and the Table of Sanctions of the Regulation on Control and Sanction of Fisheries and Aquaculture Activities approved by Supreme Decree N° 017-2017-PRODUCE” and their statement of reasons is ordered so that the comments and/or suggestions from the citizens can be received for a period of fifteen (15) calendar days, counted from November 20, 2019.

VI. Head Office Resolution N° 132-2018-FONDEPES/J establishing the creation of the Digital Government Committee is amended

Through Head Office Resolution N° 155-2019-FONDEPES/J, published in the Official Gazette “El Peruano” on November 20, 2019, Sections 1 and 2 of Head Office Resolution N° 132-2018-FONDEPES/J are amended and the Head Office Resolution N° 307-2015-FONDEPES/J that creates the Information Security Committee, and their amendments approved by Head Office Resolution N° 082-2016-FONDEPES/J and Head Office Resolution N° 066-2018-FONDEPES/J are annulled.

VII. The Regulation on the processing of waste from hydro-biological resources approved by Supreme Decree N° 005-2011-PRODUCE is amended

Through Supreme Decree N° 018-2019-PRODUCE published in the Official Gazette “El Peruano” on November 25, 2019, the amendment of the third paragraph of section 9 of the Regulation on the processing of hydro-biological resources waste approved by Supreme Decree N° 005-2011-PRODUCE is ordered, as detailed below:

“Section 9.-

(…)

The industrial and artisanal fishing facilities for direct human consumption that do not have an authorized residual hydro-biological fishmeal plant will enter into supply agreements with the authorized residual hydro-biological fishmeal plants in order to ensure the final location and processing of their waste, these agreements will be verified by the General Department for Supervision, Control and Sanctions of the Office of the Ministry of Production. The industrial fishing facilities that have processing plants for direct human consumption and conventional fishmeal plants and or high-protein fishmeal plants will be able to process the waste only from their plants for direct human consumption; in addition, they will be able to process their waste in residual hydro-biological residual fishmeal plants that have a current operation license, prior signing of a supply agreement”.         

VIII. Peruvian Technical Standards version 2019 concerning trout, milk and dairy products, electrical household appliances, rail vehicles and others are approved

Through Director’s Resolution N° 024-2019-INACAL/DN published in the Official Gazette “El Peruano” on November 28, 2019, Peruvian Technical Standards concerning trout, milk, dairy products, electrical household appliances, rail vehicles and others are approved and rendered ineffective.

APPOINTMENTS

I. The Director of the Processing Department for Direct and Indirect Human Consumption of the Department for Direct and Indirect Human Consumption Fisheries is appointed.

Through Ministerial Resolution N° 472-2019-PRODUCE published in the Official Gazette “El Peruano” on November 1, 2019, Mrs. Luz Amelia Pisúa Gonzales was appointed as Director of the Processing Department for Direct and Indirect Human Consumption of the Department for Direct and Indirect Human Consumption Fisheries of the Deputy Minister of Fisheries and Aquaculture of the Ministry of Production.

II. General Director of Artisanal Fisheries and Aquaculture Investment of FONDEPES is appointed

Through Head Office Resolution N° 149-2019-FONDEPES/J published in the Official Gazette “El Peruano” on November 1, 2019, Mr. Jorge Roberto Ñahue Sivirichi is appointed as General Director of Artisanal Fisheries and Aquaculture Investment of the National Fisheries Development Fund.

III. Study and Project Coordinator of the General Department for Artisanal Fisheries and Aquaculture Investment of FONDEPES is appointed

Through Head Office Resolution N° 151-2019-FONDEPES/J published in the Official Gazette “El Peruano” on November 6, 2019, Mr. Juan Yimer Zamudio Revilla is appointed as Study and Project Coordinator of the General Department for Artisanal Fisheries and Aquaculture Investment of the National Fisheries Development Fund.

IV. Advisor I of the Head Office of the National Fisheries Development Fund – FONDEPES is appointed

Through Head Office Resolution N° 152-2019-FONDEPES/J published in the Official Gazette “El Peruano” on November 11, 2019, Mr. Miguel Eliseo Kuzma Alfaro is appointed as Advisor I of the Head Office of the National Fisheries Development Fund – FONDEPES.
