CLOSED SEASON AND AUTHORIZATIONS

I. Authorization of execution of “Operación Merluza XXVIII” in maritime area between Punta Sal and Pimentel to IMARPE

Pursuant to Ministerial Order No. 408-2019-PRODUCE published on October 5, 2019 in the Official Gazette “El Peruano”, it is set forth to authorize the Marine Institute of Peru (IMARPE) to execute Hake Fishing Operation “Operación Merluza XXVIII” in the maritime area between Punta Sal (04º00’S) and Pimentel (07º00’S) from 00:00 hours, October 10 to 23:59 hours, October 12, 2019 being involved 5 regular fishing vessels and 1 substitute fishing vessel, all holding fishing permits in force and operating under Provisional Fishing Scheme for hake (Merluccius gayi peruanus) resources by virtue of Ministerial Order No. 290-2019-PRODUCE.

II. Adoption of temporary measure for Bonito protection early alert

Pursuant to Supreme Executive Order No. 014-2019-PRODUCE published on October 6, 2019 in the Official Gazette “El Peruano”, it is set forth to adopt the temporary measure for early alert to protect Bonito (Sarda chiliensis chiliensis) resources.

III. Establishing closed season for breeding “Carachi amarillo” in Lake Titicaca basin and high-Andean bodies of water in Puno region

Pursuant to Ministerial Order No. 432-2019-PRODUCE published on October 16, 2019 in the Official Gazette “El Peruano”, it is set forth to establish closed season for breeding “Carachi amarillo” (Orestias luteus) hydrobiological resources in the Lake Titicaca basin and high-Andean bodies of water in Puno region for 4-week period for year 2019, starting from October 17, 2019. Therefore, any fishing activities involving this species is prohibited, as well as its trading and carriage in such region.

IV. Declaring closed season for breeding silverside hydrobiological resources, as per Ministerial Order No. 385-2019-PRODUCE, open as well as authorization of restarting silverside fishery activities as of October 28

Pursuant to Ministerial Order No. 434-2019-PRODUCE published on October 18, 2019 in the Official Gazette “El Peruano”, it is set forth to declare closed season for breeding Chilean silverside (Odontesthes regia) hydrobiological resources, as per Ministerial Order No. 385-2019-PRODUCE, open by authorizing silverside fishery activities to be restarted as of 00:00 hours, October 28, 2019.

V. Declaring closed season for breeding hake resources, as per Ministerial Order No. 369-2019-PRODUCE, open as well as authorization of restarting hake fishery activities in the maritime domain

Pursuant to Ministerial Order No. 438-2019-PRODUCE published on October 19, 2019 in the Official Gazette “El Peruano”, it is set forth to declare closed season for breeding Peruvian hake (Merluccius gayi peruanus) resources, as per Ministerial Order No. 369-2019-PRODUCE, open by authorizing hake fishery activities to be restarted in the maritime area between 04°00’S and 07°00’S of the Peruvian maritime domain as of 00:00 hours, October 20, 2019.

  1. Approval of Public Funds to FONDEPES and SANIPES

Pursuant to Ministerial Order No. 454-2019-PRODUCE published on October 25, 2019 in the Official Gazette “El Peruano”, it is set forth to approve the Public Funds charged against the 2019 Institutional Budget of the Budgetary Public Entity 038: Ministry of Production, Executing Unit 001: Ministry of Production through the “Directly Collected Resources” financing source both to the Budgetary Public Entity 059: Peruvian Fisheries Development Fund (FONDEPES) up to the sum amounting to S/6´920,828.00 (SIX MILLION NINE HUNDRED TWENTY THOUSAND EIGHT HUNDRED TWENTY-EIGHT AND 00/100 SOLES), and to the Budgetary Public Entity 243: Peruvian Administration of Fishery Health (SANIPES) up to the sum amounting to S/4´226,564.00 (FOUR MILLION TWO HUNDRED TWENTY-SIX THOUSAND FIVE HUNDRED SIXTY-FOUR AND 00/100 SOLES).

These public funds aim to finance those interventions prioritized in the last quarter in 2019.

VII. Closing Chilean jack mackerel fishing season for large-scale fleet

Pursuant to Ministerial Order No. 455-2019-PRODUCE published on October 25, 2019 in the Official Gazette “El Peruano”, it is set forth to close Chilean jack mackerel (Trachurus murphyi) fishing season for large-scale fleet as of 00:00 hours, October 26, 2019.

GENERAL REGULATIONS

I. Providing the publication of the draft “Supreme Executive Order amending Section 6 of Tuna Fisheries Management Regulation, approved by Supreme Executive Order No. 032-2003-PRODUCE” and its Preambles

Pursuant to Ministerial Order No. 403-2019-PRODUCE published on October 2, 2019 in the Official Gazette “El Peruano”, it is set forth to publish the draft “Supreme Executive Order amending Section 6 of the Tuna Fisheries Management Regulation, approved by Supreme Executive Order No. 032-2003-PRODUCE”, as well as its Preambles on the Ministry of Production website (www.gob.pe/produce) in order to receive opinions, comments and/or suggestions from citizens within 15 business day, starting from October 3, 2019.

II. Establishing provisions in relation to the program benefits regulated by Section 18 of the Legislative Order No. 1084 Act of Maximum Catch Limits per Vessel

Pursuant to Supreme Executive Order No. 013-2019-PRODUCE published on October 4, 2019 in the Official Gazette “El Peruano”, it is set forth to establish provisions in relation to the program benefits regulated by Paragraphs b), c) and d) of Items 1 and 2, Section 18, Legislative Order No. 1084 Act of Maximum Catch Limits per Vessel, as well as the start of the final period of benefit programs.

III. Amendment to Exhibit I titled “Minimum catch size and maximum tolerance of juvenile specimens for catching main seawater fishes” of the Ministerial Order No. 209-2001-PE regarding cabinza grunt resources

Pursuant to Ministerial Order No. 416-2019-PRODUCE published on October 8, 2019 in the Official Gazette “El Peruano”, it is set forth to amend Exhibit I titled “Minimum catch size and maximum tolerance of juvenile specimens for catching main seawater fishes” of the Ministerial Order No. 209-2001-PE regarding cabinza grunt (Isacia conceptionis) resources as per the following details:

IV. Approval of Guidelines on Quota Allocation of Chilean Jack Mackerel in the High Seas granted by the South Pacific Regional Fisheries Management Organisation to the Peruvian Government

Pursuant to Ministerial Order No. 418-2019-PRODUCE published on October 10, 2019 in the Official Gazette “El Peruano”, it is set forth to approve the “Guidelines on Quota Allocation of Chilean Jack Mackerel (Trachurus murphyi) in the High Seas granted by the South Pacific Regional Fisheries Management Organisation to the Peruvian Government”. Details are visualized in the Exhibits thereof.

V. Providing publication of “Ministerial Order approving Guidelines for the Selection Process of the Artisanal Fishworkers Social Organization to be in charge of the administrative management of a non-transferred artisanal fishery infrastructure” on the Ministry of Production website

Pursuant to Ministerial Order No. 421-2019-PRODUCE published on October 11, 2019 in the Official Gazette “El Peruano”, it is set forth to publish the draft “Ministerial Order approving Guidelines for the Selection Process of the Artisanal Fishworkers Social Organization to be in charge of the administrative management of a non-transferred artisanal fishery infrastructure” on the Ministry of Production website (www.gob.pe/produce) in order to receive opinions, comments and/or suggestions from citizens within 10 calendar days, starting from October 12, 2019.

VI. Providing publication of the draft Ministerial Order approving the model of the “Administrative Management Agreement of Artisanal Fishery Infrastructures” entered into by the Ministry of Production of Regional Government, FONDEPES and the Artisanal Fishworkers Social Organization on the Ministry of Production website

Pursuant to the Ministerial Order No. 422-2019-PRODUCE published on October 11, 2019 in the Official Gazette “El Peruano”, it is set forth to publish the draft Ministerial Order approving the model of the “Administrative Management Agreement of Artisanal Fishery Infrastructures” entered into by the Ministry of Production of Regional Government, FONDEPES and the Artisanal Fishworkers Social Organization on the Ministry of Production website (www.gob.pe/produce) in order to receive opinions, comments and/or suggestions from citizens within 10 calendar days, starting from October 12, 2019.

VII. Providing publication of the draft “Ministerial Order approving the Artisanal Fishery Infrastructures Administration Manual” on the Ministry of Production website

Pursuant to Ministerial Order No. 423-2019-PRODUCE published on October 11, 2019 in the Official Gazette “El Peruano”, it is set forth to publish the draft “Ministerial Order approving the Artisanal Fishery Infrastructures Administration Manual” on the Ministry of Production website (www.gob.pe/produce) in order to receive opinions, comments and/or suggestions from citizens within 10 calendar days, starting from October 12, 2019.

VIII. Providing publication of the draft “Ministerial Order approving the Artisanal Fishery Infrastructures (IPA) Administration Management Supervision Regulation” on the Ministry of Production website

Pursuant to Ministerial Order No. 424-2019-PRODUCE published on October 12, 2019 in the Official Gazette “El Peruano”, it is set forth to publish the draft “Ministerial Order approving the Artisanal Fishery Infrastructures (IPA) Administration Management Supervision Regulation” on the Ministry of Production website (www.gob.pe/produce) in order to receive opinions, comments and/or suggestions from citizens within 10 calendar days, starting from October 13, 2019.

IX. Providing publication of the draft Ministerial Order approving the Regulation setting forth criteria to fix tariffs applicable to services rendered in artisanal fishery infrastructures

Pursuant to Ministerial Order No. 426-2019-PRODUCE published on October 12, 2019, it is set forth to publish the draft Ministerial Order approving the Regulation setting forth criteria to fix tariffs applicable to services rendered in artisanal fishery infrastructures on the Ministry of Production website (www.gob.pe/produce) in order to receive opinions, comments and/or suggestions from citizens within 10 calendar days, starting from October 13, 2019.

X. Amendment to the Supreme Executive Order No. 006-2016-PRODUCE and establishing general provisions to strengthen artisanal fishery in productive chains

Pursuant to Supreme Executive Order No. 016-2019-PRODUCE published on October 17, 2019 in the Official Gazette “El Peruano”, it is set forth to amend Paragraph a), Subsection 6.9, Section 6 of the Supreme Executive Order No. 006-2016-PRODUCE, to read as follows:

“Section 6. Fishing permits

(…)

6.9 Fishing permits granted within the framework of

Pilot Programs expire on the following cases:

a) The last business day of March 2020

in case of failure the condition

set forth in Paragraph d), Subsection 5.2, Section 5

of this Supreme Executive Order.

(…)”

Additionally, general provisions are set forth to strengthen artisanal fishery in productive chains.

XI. Amendment to Exhibit 2 – Minimum Technical Specifications of the Regulation of Satellite Tracking System (SISESAT) for fishing vessels, passed by Supreme Executive Order No. 001-2014-PRODUCE

Pursuant to Ministerial Order No. 433-2019-PRODUCE published on October 17, 2019 in the Official Gazette “El Peruano”, it is set forth to amend Items 1, 2 and 3 of Exhibit 2 – Minimum Technical Specifications of the Regulation of Satellite Tracking System (SISESAT) for fishing vessels, passed by Supreme Executive Order No. 001-2014-PRODUCE. Details are visualized in the Exhibits thereof.

XII. Establishing minimum approach distances to cetaceans

Pursuant to Ministerial Order No. 451-2019-PRODUCE published on October 22, 2019 in the Official Gazette “El Peruano”, it is set forth to establish the minimum approach distances to cetaceans according to the following details below:

Minimum approach distances
a)    Small cetaceans 50 meters
b)    Cetaceans with more than five meters long 100 meters
c)    Small cetaceans in feeding or socialization activities 150 meters
d)    Cetaceans with more than five meters long in feeding or socialization activities 300 meters

Additionally, it is prohibited to go toward or approach to cetacean groups with calves or a mother whale with its calf. Whether finding cetacean groups with calves or a mother whale with its calf on a non-deliberate basis, such area shall be left in a slowly manner maintaining a minimum distance of 300 meters.

XIII. Approval of “Inspection Schedule to Verify Technical Characteristics of Fishing Vessels included in the List as per Director’s Order No. 0109-2019/GOB.REG.TUMBES-DRP-DR of the Regional Direction of Production, Regional Government of Tumbes”

Pursuant to Ministerial Order No. 459-2019-PRODUCE published on October 30, 2019 in the Official Gazette, it is approved the Inspection Schedule and the Technical Inspection Report to Verify Technical Characteristics of Fishing Vessels included in the aforementioned List. Details are visualized in the Exhibits thereof.

XIV. Approval of Terms of Reference to prepare corrective environmental management instruments for manufacturing and domestic trade sector

Pursuant to Ministerial Order No. 466-2019-PRODUCE published on October 31, 2019 in the Official Gazette “El Peruano”, it is set forth to approve the following Terms of Reference:

  • Terms of Reference to prepare the Environmental Adequacy Statement (DAA) for the ongoing activity in the manufacturing sector
  • Terms of Reference to prepare the Environmental Adequacy and Management Program (PAMA) for the ongoing activity in the manufacturing sector
  • Terms of Reference to prepare the Environmental Adequacy Statement (DAA) for the ongoing activity in the domestic trade sector
  • Terms of Reference to prepare the Environmental Adequacy and Management Program (PAMA) for the ongoing activity in domestic trade sector

APPOINTMENTS

I. Appointment of Chief of Fishery and Aquaculture Supervision and Control Division, as well as Head of Human Resources Unit of the Peruvian Administration of Fishery Health (SANIPES)

Pursuant to Administrator’s Order No. 080-2019-SANIPES/PE published on October 1, 2019 in the Official Gazette “El Peruano”, it is set forth to appoint Juan Manuel IPANAQUÉ ZAPATA as Chief of Fishery and Aquaculture Supervision and Control Division of SANIPES.

Likewise, it is set forth to appoint Karina Yodell CABEZAS ACHA as Head of Human Resources Unit of SANIPES.

II. Appointment of Head of Procurement Unit of SANIPES

Pursuant to Administrator’s Order No. 083-2019-SANIPES/PE published on October 2, 2019 in the Official Gazette “El Peruano”, it is set forth to appoint Joseph Israel STEIN BERTRAN as Head of Procurement Unit of SANIPES.

III. Entrusting with functions of Coordinator of Assessments and Projects of the General Division of Artisanal Fishery and Aquaculture Investment, FONDEPES

Pursuant to Director’s Resolution No. 139-2019-FONDEPES/J published on October 4, 2019 in the Official Gazette “El Peruano”, Javier Manuel VÁSQUEZ PONCE is temporary entrusted with functions of Coordinator of Assessments and Projects of the General Division of Artisanal Fishery and Aquaculture Investment, FONDEPES.

IV. Appointment of Chief of General Division of Aquaculture

Pursuant to Ministerial Order No. 410-2019-PRODUCE published on October 5, 2019 in the Official Gazette “El Peruano”, it is set forth to appoint Carlos Raúl CASTILLO ROJAS as Chief of General Division of Aquaculture, Office of the Vice-Minister of Fishery and Aquaculture, Ministry of Production.

V. Appointment of Head of Aquaculture Promotion and Development Unit of the General Division of Aquaculture

Pursuant to Ministerial Order No. 413-2019-PRODUCE published on October 5, 2019 in the Official Gazette “El Peruano”, it is set forth to appoint Carlos Feliciano CISNEROS VARGAS as Head of Aquaculture Promotion and Development Unit of the General Division of Aquaculture, Office of the Vice-Minister of Fishery and Aquaculture, Ministry of Production.

VI. Appointment of Head of Aquaculture Management of the General Division of Aquaculture

Pursuant to Ministerial Order No. 414-2019-PRODUCE published on October 5, 2019 in the Official Gazette “El Peruano”, it is set forth to appoint Edgar Ovidio García Carbajal as Head of Aquaculture Management of the General Division of Aquaculture, Office of the Vice-Minister of Fishery and Aquaculture, Ministry of Production.

VII. Appointment of Executive Coordinator of the National Productive Diversification Program

Pursuant to Ministerial Order No. 450-2019-PRODUCE published on October 22 in the Official Gazette “El Peruano”, it is set forth to appoint Jonatán Jorge RÍOS MORALES as Executive Coordinator of the National Productive Diversification Program of the Ministry of Production.

VIII. Appointment of Second Advisor of the Office of the Minister of Production

Pursuant to Ministerial Order No. 457-2019-PRODUCE published on October 28 in the Official Gazette “El Peruano”, it is set forth to appoint Albina RUIZ RÍOS as Second Advisor of the Office of the Minister of Production.

IX. Providing the substitution of functions of Executive Coordinator of the National Program “A Comer Pescado” (Let’s Eat Fish) by the Second Advisor of the Office of the Minister of Production

Pursuant to Ministerial Order No. 461-2019-PRODUCE published on October 31 in the Official Gazette “El Peruano”, it is set forth that the Executive Coordinator of the National Program “A Comer Pescado” (Let’s Eat Fish) of the Office of the Vice-Minister of Fishery and Aquaculture, Ministry of Production, shall be substituted by Albina RUIZ RÍOS, Second Advisor of the Office of the Minister of Production.

X. Appointment of Director of the “Fishery Center of Productive Innovation and Technology Transfer (CITE) – Amazon-Pucallpa”

Pursuant to Ministerial Order No. 468-2019-PRODUCE published on October 31 in the Official Gazette “El Peruano”, it is set forth to appoint Jorge Alberto TENORIO MORA as Director of the “Fishery Center of Productive Innovation and Technology Transfer (CITE) – Amazon-Pucallpa”.
