Adoption of the “Procedure for registering and updating Purchase Orders in the Purchase Order Control System (SCOP)”
By Resolution of the Board of Directors OSINERGMIN N° 025-2021-OS/CD, published in the Official Gazette El Peruano, on February 19, 2021 (“Resolution“), the “Procedure for registering and updating Purchase Orders in the Purchase Order Control System (SCOP)” (“Procedure“) was adopted
The purpose of the Procedure is to: (i) integrate and update the main regulatory provisions relating to the Purchase Order Control System (“SCOP“), (ii) establish a schedule for the reincorporation of the agents of the LPG commercialization chain that were excluded from the SCOP by Board of Directors Resolution N° 183-2011-OS/CD (i.e., LPG Sales Premises, LPG Distribution Networks, LPG Direct Consumers with storage capacity less than or equal to 1000 gallons and LPG Distributors in cylinders), (iii) include in the SCOP the purchase operations carried out by Rural Taps and Direct Consumers of Liquid Fuels and Other Products Derived from Hydrocarbons to Retail Distributors, (iv) adapt the SCOP provisions, considering the elimination of the differentiation between LPG-E and LPG-G products, and the differentiation of Diesel BX for Vehicular Use, given the exclusion of LPG and Diesel BX from the list of Products involved in the Fund for the Stabilization of Prices of Petroleum Derived Fuels, adopted by Supreme Decree N° 007-2020-EM, and (v) regulate the provisions applicable to the registration and updating of purchase orders in the SCOP.
As a result of the amendments introduced by the Procedure, the Resolution also provided for the amendment of the paragraph referred to the non-compliance with the obligations related to the SCOP in the Classification and Scale of Fines and Sanctions of Hydrocarbons, contained in the Classification of Infractions and Scale of Fines and Sanctions of Osinergmin, adopted by Resolution of the Board of Directors No. 271-2012-OS-CD.
The Resolution entered into force on the day following its publication; that is, on February 20, 2021.
