Resolution Nº 222-2012-OS/CD, which adopted the “Procedure for Registration in the Register of Persons who will prepare the Risk Index Report of Buried Tank Systems (STE)” and issued complementary provisions, was repealed

Resolution Nº 015-2022-OS/CD, published on January 31, 2022 in the Official Gazette “El Peruano”, repealed Resolution Nº 222-2012-OS/CD which adopted the “Procedure for Registration in the Register of Persons who will prepare the Risk Index Report of Buried Tank Systems (STE)” and issued complementary provisions (“Resolution 222”).

As a result of the publication of Supreme Decree Nº 001-2022-EM, which repealed the “Regulation for the Periodic Inspection of Tightness of Pipelines and Buried Tanks that store Liquid Fuels and Other Products Derived from Hydrocarbons” that established the obligation of the operators of buried tank systems (“Operators”) to submit to OSINERGMIN a risk index report determining the periodicity with which the tightness inspection of the STE will be carried out, prepared by professionals registered in the Register of Persons who will prepare the Risk Index Reports of STE (“Register”), in accordance with the procedure adopted by Resolution 222.

As Supreme Decree Nº 001-2022-EM regulates the periodicity that the Operators must follow to carry out the tightness inspection tests, and eliminates the obligation to submit to OSINERGMIN risk index reports prepared by persons registered in the Register, it is not useful to keep in force the procedure regulated by Resolution 222.
