Amendments to the Operating Regulations of the Oil Fuels Price Stabilization Fund

Through Board Resolution No. 235-2020-MINEM-DGH, published in the Official Gazette El Peruano, on January 1, 2021, the Operating Regulations of the Oil Fuels Price Stabilization Fund (hereinafter, the “FEPC“) were amended and adopted by Board Resolution No. 052-2005-MINEM-DGH, in order to optimize the operation of the FEPC through the creation of a digital platform for the registration and processing of the FEPC Self-assessments, providing for such purpose the following:

1. The definition of “Self-assessment” is incorporated, stating that it is: “Document as a sworn statement, which contains information of the Primary Sale, Import or Export of Products within the scope of Emergency Decree No. 010-2004 and its amendments, carried out by the Producer, Importer or Exporter, respectively; according to the Format determined by the Administrator of the Fund”.

2. Paragraph 5.1 of the FEPC Operating Regulations was amended, stipulating that the Self-assessments submitted by the Producers, Importers and Exporters to the Administrator of the FEPC must comply with the format published in the website of the Ministry of Energy and Mines, section of Hydrocarbons. Likewise, it is established that the Self-assessments must be submitted through the digital platform, enabled by the Trustee, in a PDF type file signed by its representatives and in a file type for Excel. The presentation may also be physical and on compact disc (CD) or via e-mail, as instructed.

In addition, it is provided that Self-assessments that do not comply with the established format or that are not duly signed or that are submitted by Producers, Importers and Exporters who have not previously complied with the provisions of paragraphs 5.2 of the FEPC Operating Regulations, shall not produce effects with respect to the FEPC and shall be considered as not having been submitted.

3. Other amendments that shall allow the operation of the digital platform for the registration and processing of the FEPC Self-assessments.
