Supreme Decree Nº 011-2023-EM (the “Supreme Decree”), published on May 25, 2023 in the Official Gazette “El Peruano”, approved the amendment of Article 1 of Supreme Decree Nº 023-2021-EM, which provided for the incorporation of Liquefied Petroleum Gas intended for Bottling (“LPG – E”) in the mechanism of the Fund for the Stabilization of Prices of Petroleum Derived Fuels (“FEPC”), under the compliance of certain technical conditions. This, in order to postpone the withdrawal of LPG – E from the FEPC mechanism, until August 31, 2023.
The measure adopted responds to the slow economic recovery of the country, the lack of predictability in the evolution of the international price of LPG, and the situation of port closures due to anomalous high intensity waves that will be maintained during the following months.
