Article 3 of the Board Resolution Nº 129-2021- MINEM/DGH that adopted the “Guidelines and technical provisions necessary for the preparation of Safety Risk Studies and Emergency Response Plans” is amended

 

By Board Resolution Nº 387-2022-MINEM/DGH (“Resolution”), published on November 29, 2022 in the Official Gazette “El Peruano”, Article 3 of Board Resolution Nº 129-2021- MINEM/DGH that adopted the “Guidelines and technical provisions necessary for the preparation of the Safety Risk Studies and Emergency Response Plans” (“Guidelines”) was amended, referring to the update of the Safety Risk Studies and Emergency Response Plans.

The aforementioned article provided that the Authorized Companies that have Safety Management Instruments (“Instruments”) adopted and/or with a favorable opinion from the Supervisory Body of Investment in Energy and Mining (“OSINERGMIN”), issued more than five years ago, had to submit an update of their Instruments in accordance with the Guidelines, within six months after the entry into force of the technical regulations adopted by OSINERGMIN. On May 28, 2022, the “Procedure for the issuance of favorable opinion of the Safety Risk Studies and Emergency Response Plans for Hydrocarbon Activities and Facilities that are within the scope of application of the Safety Regulations for Hydrocarbon Activities adopted by Supreme Decree Nº 043-2007-EM” (“Procedure”) was published.

On November 24, 2022, the OSINERGMIN informed the General Directorate of Hydrocarbons about the progress in the update of the Instruments, noting that to date there are several companies that have Instruments pending update, so it is relevant and necessary to extend the deadline initially foreseen.

By means of the Resolution, the updating period was extended to twelve months from the effective date of the Procedure, i.e., until May 28, 2023.
