Providing starting dates for exercising functions transferred to the Lima and Callao Urban Transportation Authority

On October 12, 2019, Director’s Resolution No. 32-2019-ATU/PE (the “Resolution”) was published in the Official Gazette “El Peruano”, whereby it is set forth that:

(i) October 16, 2019 shall be the starting date for exercising functions transferred to Lima and Callao Urban Transportation Authority (“ATU”) by the Urban Transportation Management of the Metropolitan Municipality of Lima (“MML”) and the General Urban Transportation Management of the Provincial Municipality of Callao (“MPC”) as provided for by Act No. 30900 and its Regulations; and

(ii) January 2, 2020 shall be the starting date for exercising functions by ATU related to administrative sanction procedures for transportation categories provided for in Ordinance No. 2162 issued by MML. Such functions are: evaluate evidence for the defense; prepare final preliminary investigation report; issue sanction or dismissal resolutions; respond to pertinent remedies and non-contentious requests arising from issuing of Superintendency of Land Transportation of Passengers, Cargo and Goods (SUTRAN) traffic tickets and imposition of traffic violations; as well as to provide respective SUTRAN traffic ticket forms. Until the aforementioned date, the Tax Administration Service (“SAT”) will exercise such functions.

It should be mentioned that, pursuant to Act No. 30900 and its Regulation, ATU is the competent agency to plan, regulate, manage, supervise, control and promote the efficient operating capacity of the Lima and Callao Integrated Transportation System in order to reach an integrated urban land mass transportation service network of high quality, wide service area, modern technology, environmentally clean, technically efficient, and economically sustainable.
