Supreme Executive Order amending Specific Telecommunication Equipment and Apparatus Approval Regulation is passed

On June 12, 2019, Supreme Executive Order No. 019-2019-MTC amending the Specific Telecommunication Equipment and Apparatus Approval Regulation, passed by Supreme Executive Order No. 001-2006-MTC, is published in the Official Gazette “El Peruano”.

Main amendments included in the regulation are as follows:

(i) Simplification of approval procedure by measures like formalities with Foreign Trade One-Stop Shop (VUCE).

(ii) Amendment including new exceptions to the need of having an approval certificate for equipment to be used in amateur radio services, and mobile terminal equipment for non-resident traveler.

(iii) Communications Regulatory Compliance Control Unit of the Ministry of Transportation and Communications is the authority in charge to approve telecommunications equipment and issue the pertinent certificate.

(iv) Amendment including the Type Allocation Code (TAC) in the approval certificate. TAC is a code enabling identification of brand, model and other own characteristic of the mobile terminal equipment, and it is composed by the first IMEI eight digits.

(v) Approval certificate that does not comply with including TAC will be valid only until April 5, 2020.

(vi) Operators are obliged to carry out awareness campaigns about the importance of the use of approved equipment, and implement mechanisms that deny not approved mobile terminal equipment access to their networks.
