Amendment to the COES Technical Procedure No. 26 “Calculation of the Firm Power”

On August 31, 2019, OSINERGMIN Directing Board’s Order No. 144-2019-OS/CD (“Order”) was published on the Official Gazette “El Peruano”. It sets forth to amend Item 8.6.3 of the Economic Operation Committee of the National Interconnected System (COES) Technical Procedure No. 26 “Calculation of the Firm Power” (“PR-26”) approved by Ministerial Order No. 344-2004-MEM/DM.

The Order is applicable to Renewable Energy Resources (“RER”) Generation Plants using wind, solar and tidal technologies. In this regards, it is inserted in PR-26 that the Firm Power of these plants shall be determined considering their active power generation during peak hours (“HP”) of the Peruvian Interconnected Electric Power System (SEIN), defined by the Ministry of Energy and Mines, from the last 36 months. In case such historical series or data is not available, it shall be consider the generation from the commercial operation date of the plant under analysis to the corresponding month of assessment.

In this sense, considering the power production during peak hours, wind energy will be the most benefited technology from this regulatory amendment. It should be noted that this regulation does not exclude plants awarded Renewable Energy Auctions from its scope of application.

Finally, it should be mentioned that provisions of the Order came into force as of September 1, 2019.
