SMV Rules

The Superintendence of the Stock Market (“SMV”) approves new Directive for the management and attention of complaints of alleged acts of corruption in the SMV and granting of protection measures (“Directive”). By means of Superintendent’s Resolution N° 100-2023-SMV/02, published in the Institutional Websitr of the SMV in the Single Digital Platform of the Peruvian State on November 23, 2023, the SMV approved the aforementioned Directive, mainly to incorporate the participation of its Institutional Control Body in various procedures for the treatment of complaints contemplated therein.

SBS Regulations

The Superintendency of Banking, Insurance and Private Pension Fund Administrators (“SBS”) approves modification of the Regulation for the Management of Information Security and Cybersecurity, approved by SBS Resolution N° 504-2021 (“Regulation”) and Circular N° S-661-2016 on Insurance Products Subject to the Simplified Regime of Due Diligence in the Knowledge of the Client (“Circular”). By means of SBS Resolution N° 3797-2023, published in the Official Gazette El Peruano on November 15, 2023, the SBS mainly approved to amend:
The Regulation, in order to contemplate as an exception to the requirement to use two factors for the verification of the user’s identity and the adoption of necessary measures to reduce the possibility of identity impersonation, to the case of insurance products included in the simplified regime of due diligence of customer knowledge, as established in Article 31 of the Regulation on Risk Management of Money Laundering and Terrorism Financing, approved by SBS Resolution N° 2660-2015 (“Simplified Regime”), in which case a single biometric factor may be used.
The Circular, to exclude life insurance with savings, investment or redemption component and surety insurance, from the aforementioned Simplified Regime.
The Regulation, to grant more alternatives for compliance with the requirement to generate a unique code per operation to carry out the reinforced authentication for operations through digital channels.
