CLOSURES AND AUTHORIZATIONS

I. CATCH LIMITS (QUOTA) FOR BONITO FOR 2023 APPLICABLE TO PURSE SEINE VESSELS GREATER THAN OR EQUAL TO 20 M3 WERE ESTABLISHED

By Ministerial Resolution No.090-2023-PRODUCE, published in an extraordinary edition of the Official Gazette “El Peruano” on March 2, 2023, the catch limits (quota) for the year 2023 of the bonito resource (Sarda chiliensis chiliensis), applicable to the purse seine fleet greater than or equal to 20 m3 were established.

The applicable quota of jack mackerel will be 43,826 tons and is distributed as follows:

  • 18,567 tons from January to April 30.
  • 4,510 tons from May 1 to June 30.
  • 1,814 tons from July 1 to August 31.
  • 8,426 tons from September 1 to October 31.
  • 10,509 tons from November 1 to December 31.

“The established quotas may be modified according to biological- fishery and/or environmental factors as deemed by the Instituto del Mar del Perú – IMARPE, for which it will send the Ministry of Production the recommendation for the corresponding measures”.

II. A REPRODUCTIVE CLOSURE OF THE HAKE RESOURCE WAS ESTABLISHED

By Ministerial Resolution No.098-2023-PRODUCE, published in the Official Gazette “El Peruano” on March 10, 2023, it was established the reproductive closure of the hake resource (Merluccius gayi peruanus), in the maritime area between the northern limit of the maritime domain and 04″00’S, for thirty (30) calendar days from 00.00 hours of the day following the publication of this resolution. This provision is not applicable to artisanal fishery vessels implemented with passive fishery gear and equipment.

Processing is carried out within forty-eight (48) hours of the beginning of the closure. Commercialization is allowed as long as there is documentation proving that the resource was extracted prior to the establishment of the closure.

III. MODIFICATION OF JACK MACKEREL AND MACKEREL CATCH QUOTA FOR 2023 APPLICABLE TO LARGE-SCALE VESSELS

By means of Ministerial Resolution No. 103-2023-PRODUCE published in the Official Gazette “El Peruano” on March 11, 2023, the catch quota for jack mackerel and mackerel resources applicable to larger scale fishery vessels and established by Ministerial Resolution No. 042-2023-PRODUCE is modified, increasing the jack mackerel quota to 83,598 tons and the mackerel quota to 26,558 tons.

IV. JACK MACKEREL HARVESTING ACTIVITIES FOR LARGER SCALE VESSELS ARE TERMINATED

By means of Ministerial Resolution N° 118-2023-PRODUCE published in the extraordinary edition of the official gazette “El Peruano” on March 17, 2023, the extractive activities of jack mackerel resource for larger scale vessels were terminated as of 00.00 hours of the day following the publication of the resolution.

Vessels may carry out their unloadings beyond that date provided that they can prove that they have had authorization to set sail prior to that date. The processing, storage, commercialization and transportation must have documentation of certain date that proves that the resource was caught within the indicated period.

GENERAL REGULATIONS

I. APPROVAL OF THE LIST OF BENEFICIARIES OF ARTISANAL FISHERMEN WITHIN THE FRAMEWORK OF THE EMERGENCY DECREE 004-2023

By means of Ministerial Resolution No. 091-2023-PRODUCE, published in an extraordinary edition of the Official Gazette “El Peruano” on March 2, 2023, the Register of Beneficiaries of Artisanal Fishermen was approved within the framework of the provisions of Emergency Decree No. 004-2023 that grants an economic subsidy in favor of artisanal fishermen within the framework of the Economic Reactivation Plan “Con Punche Perú” for an amount of S/. 500 soles.

II. THE AGREEMENT AND ITS ENTRY INTO FORCE TO PROMOTE COMPLIANCE WITH INTERNATIONAL CONSERVATION AND MANAGEMENT MEASURES BY FISHERY VESSELS FISHERY ON THE HIGH SEAS WERE PUBLISHED

On March 10, 2023, the “Agreement to Promote Compliance with International Conservation and Management Measures by Fishery Vessels on the High Seas” was published in the Official Gazette “El Peruano”, which was adopted on November 24, 1993 by the Conference of the Food and Agriculture Organization of the United Nations (FAO), approved by Legislative Resolution No. 31606 of November 4, 2022 and internally ratified by Supreme Decree No. 003-2023-RE of February 10, 2023, entered into force on April 24, 2023.

III. APPROVAL OF THE ANNUAL PLAN FOR ENVIRONMENTAL ASSESSMENT AND CONTROL – PLANEFA OF THE FISHERIES AND AQUACULTURE SECTOR

By means of Ministerial Resolution No. 111-2023-PRODUCE published in an extraordinary edition of the Official Gazette “El Peruano” on March 15, 2023, the Annual Plan of Evaluation and Environmental Control – PLANEFA of the fishery and aquaculture sector for the year 2024 was approved, whose implementation is in charge of the General Direction of Supervision, Control and Sanction of the Vice-Ministerial Office of Fishery and Aquaculture.

IV. BY EXCEPTION, THE FIRST ANCHOVY FISHERY SEASON OF 2022 IS NOT CONSIDERED FOR THE COMPLIANCE OF THE 80% OF THE LMCE

By Ministerial Resolution Nº 121-2023-PRODUCE published in the Official Gazette “El Peruano” on March 23, 2023, it was determined by exception, that the First Anchovy Fishery Season in the north-central zone of the year 2022 will not be considered for compliance by shipowners of the obligation to extract 80% of the Maximum Catch Limit per Vessel – LMCE, as provided in paragraph 1 of Article 11 of Supreme Decree Nº 021-2008-PRODUCE.

APPOINTMENTS

I. APPOINTMENT OF ADVISOR II OF THE MINISTERIAL OFFICE AND ASSIGNED EXECUTIVE DIRECTION OF THE “NATIONAL PROGRAM OF PURCHASES FROM MYPErú”- CHIEF OF THE ADVISORS’ OFFICE

By Ministerial Resolution No. 106-2023-PRODUCE published in the Official Gazette “El Peruano” on March 11, 2023, Ms. Karin Desa Pariona Lagos was appointed as Advisor II of the Ministerial Office and is also in charge of the Executive Direction of the National Program of Purchases from MYPErú.

II. APPOINTMENT OF REPRESENTATIVE OF THE PRODUCTIVE SECTOR TO THE BOARD OF DIRECTORS OF SANIPES.

By Supreme Resolution No. 007-2023-PRODUCE published in the Official Gazette “El Peruano” on March 14, 2023, Mrs. Úrsula Desilú León Chempén was appointed as representative of the Vice-Ministerial Office of Fisheries and Aquaculture of the Ministry of Production before the Directive Council of the National Agency of Fisheries Health – SANIPES, who will preside it.

III. APPOINTMENT OF ADVISOR II OF THE VICE MINISTERIAL OFFICE OF FISHERIES AND AQUACULTURE

By means of Ministerial Resolution No. 110-2023-PRODUCE published in an extraordinary edition of the Official Gazette “El Peruano” on March 15, 2023, Ms. Erika Shantal Chávez Valdivia Herrera was appointed as Advisor II of the Vice Ministerial Office of Fisheries and Aquaculture.

IV. APPOINTMENT OF DIRECTOR OF MONITORING AND EVALUATION OF THE GENERAL DIRECTORATE OF POLICIES AND REGULATORY ANALYSIS IN FISHERIES AND AQUACULTURE

By Ministerial Resolution No. 119-2023-PRODUCE published in the Official Gazette “El Peruano” on March 22, 2023, Mr. Jesús Adalberto Baldeón Vásquez was appointed as Director of Monitoring and Evaluation of the General Directorate of Policies and Regulatory Analysis in Fisheries and Aquaculture.
