Cybersecurity and Personal Data Protection

Approval of the Regulation of the Cyber Defense Law

 

On February 14, 2024, Supreme Decree No. 017-2024-PCM was published, approving the Regulation of the Cyber Defense Law, Law No. 30999.

The Regulation aims to ensure that national cyber defense and cybersecurity capabilities maintain the continuity of their operations through the protection in and through cyberspace of national critical assets, key resources, sovereignty and national interests against threats or attacks, when these affect national security.

The following provisions of the Regulation are highlighted:

– The Ministry of Defense, within the scope of its functions and competencies, directs, regulates, supervises and evaluates cyber defense and cybersecurity arrangements.
– Passive and active cyber defense and cybersecurity measures are described, as well as the cyber defense and cybersecurity capabilities of the executing bodies of the Ministry of Defense.
– Responsibilities and stages are established for the protection, control and cybersecurity of critical national assets and key resources in and through cyberspace.

The violation of the cyber defense and cybersecurity of the Peruvian State may have serious implications from the perspective of personal data protection.

The Regulation enters into force on February 15, 2024, the day after its publication.
