Our team has a proven track record in antitrust matters, dating back to the 1990s when the first antitrust rules in Peru were enacted. This allows us to regularly participate in the most complex cases on the market.
We advise our clients in all stages of investigations and proceedings before the competition authorities (INDECOPI and OSIPTEL) and other regulatory bodies. This includes representing clients in administrative sanctioning proceedings for infringements of antitrust regulations, such as abuse of dominant position, vertical collusive practices, and horizontal collusive practices, as well as in leniency proceedings, and in the negotiation, approval, and fulfilment of termination commitments.
We also provide advice on the identification of possible anti-competitive practices and on the adoption of preventive measures to mitigate possible contingencies, including specialized training sessions, and review and design of risk matrices and compliance programs, in coordination with our compliance area, enabling our clients to identify the main risks associated with their operations.
We regularly support our clients in the review and implementation of commercial policies, exclusivity contracts, distribution, and non-competition agreements, as well as in the implementation and review of antitrust protocols for M&A transactions.
