Our Competition practice includes a multidisciplinary team, highly specialized and with extensive experience in all matters related to the defense of free and fair competition.
We have participated in the most complex cases in the market and regularly advise economic agents operating in the main economic sectors of the country, such as the energy sector, financial services, mining, food, pharmaceutical and cosmetics, automotive, telecommunications, among others.
Being one of the few Peruvian one-stop shops and having the support of one of the best corporate compliance practices in the country, allows us to provide a comprehensive and sophisticated service in the most complex competition, antitrust and consumer protection matters in an agile and effective manner.
Our Competition law team includes the following subspecialties:
Antitrust: We regularly represent our clients in connection with the requirements, investigations and procedures initiated by the competition authorities to identify and sanction anti-competitive practices. We advise our clients in the identification and prevention of possible anti-competitive practices, including the review and implementation of compliance protocols, as well as the resolution of queries related to distribution contracts, exclusivity clauses, non-compete agreements, among others.
Unfair Competition: We advise diverse companies on the prevention of unfair competition, including advertising regulations, and help our clients on handling investigations and procedures initiated by the competition authority to ensure the proper functioning of the competitive process.
Merger Control: We work closely with our clients throughout the entire Peruvian merger control regime process from the resolution of queries in connection with such regime, and until the closing of the transaction, for which we carry out a detailed analysis of the deal and represent our clients before the competition authority when its authorization needs to be sought. We have substantial experience in complex procedures handled by INDECOPI in the first and second phase.
Consumer Protection: We advise our clients on complaints, claims and conciliation procedures promoted by consumers. We also review consumer contracts and labeling projects and provide training and recommendations according to the client’s requirements to ensure their compliance with consumer protection regulations.
Elimination of Bureaucratic Barriers: We advise our clients in the identification and non-application of illegal and/or unreasonable bureaucratic barriers that affect their economic activities; achieving effective results that ensure their entry and/or permanence in the market, as well as administrative simplification.
