General Regulations
Several regulations of interest to the maritime sector were recently published in the Official Gazette El Peruano, the most relevant aspects of which are highlighted below:
Directorial Resolution No. 1075-2024 MGP/DICAP, which approves the “Complementary Provisions for the training, certification and safety of the operations of divers’ personnel and companies performing underwater and salvage work”.
- Complementary provisions are approved for the training, certification and safety of the operations of divers’ personnel and companies that perform underwater and salvage work as a result of an evaluation and review process in which civil society, personnel from the Salvage Group of the Peruvian Navy and delegates from companies specialized in underwater and salvage work participated.
- Purpose: To strengthen safety in diving activities, guarantee the competence of personnel and ensure the correct implementation of applicable standards and procedures.
- The Salvage Group of the Peruvian Navy is designated as Technical Advisor to the National Maritime Authority for issues related to diving activities.
- The regulation repeals Directorial Resolution N° 307-2007 /DCG.
- Effective: as of January 04, 2025.
Directorial Resolution N° 1052-2024 MGP/DICAPI, which approves the update of the curricular structures of the Maritime Authority Model Courses (MAM), for National Merchant Marine Personnel, Bay, Coastal, Lake and Fishery Personnel in their different categories.
- The updating of the curricular structures of the Model Courses of the Maritime Authority (MAM) for the National Merchant Marine Personnel, Bay, Coastal, Lake and Fishery Personnel in their different categories is approved.
- The Model Courses shall be developed by the aquatic training centers and the training centers recognized by the National Maritime Authority, in a time not exceeding EIGHT (8) daily periods, being the academic hour (periods) of FORTY (45) minutes per academic hour.
- Approve the model of the certificate of the Maritime Authority Model Courses (MAM), to be issued by the Aquatic Training Centers and the Training and Education Centers.
- The rule repeals Directorial Resolutions Nos. 1210-2011/DCG, 1443-2012 MGP/DCG, 0027-2013 MGP/DCG, 0034-2016 MGP/DGCG, 0781-2016 MGP/DGCG and 0646-2017/DGCG.
- Effective as of January 12, 2025.
Directorial Resolution No. 1074-2024 MGP/DICAPI, which approves guidelines for the approval and authorization of the delivery of model training courses for aquatic personnel, the model certificate of the International Maritime Organization (IMO) model courses and/or rules of Training Convention 78 as amended, and of the National Maritime Authority (MAM).
- The guidelines for the approval and authorization of model training courses for aquatic personnel required by aquatic training centers and/or aquatic training centers duly authorized by this Directorate General are approved.
- The model certificate of the model courses of the International Maritime Organization (IMO) and/or rules of Training Convention 78, as amended, to be issued by the aquatic training centers and/or aquatic training and qualification centers is approved.
- The model certificate of the model courses of the National Maritime Authority (MAM) to be issued by the aquatic training centers and/or aquatic training centers is approved.
- It was established that supervisory or management inspections will be carried out by accredited naval inspectors appointed by the General Directorate of Coast Guard and Coast Guard, in order to verify that the aquatic training centers and/or aquatic training centers comply with their respective curricula, the quality of teaching, the qualification and experience of the instructors, the development of the classes according to the curricular structure and the attendance of the students; As well as the adequate conditions in terms of infrastructure, equipment, furniture and didactic material to be used for an efficient development of the courses.
- It was stipulated that the aquatic training centers and/or aquatic training centers must comply with the established provisions regarding infrastructure, equipment, qualified teachers, system of standards, certifications, among others, in order to provide an improvement in the quality of teaching.
- The regulation repeals Directorial Resolutions No. 313-2004/DCG, 288-2011/DCG and 999-2016 MGP/DGCG.
- Effective as of January 12, 2025.
SUNARP Resolution No. 00011-2025-SUNARP/SN that provides for the entry into operation of the Information System of Movable Guarantees-SIGM.
- Resolution No. 0178-2024-SUNARP/SN, which amends the Regulations for the Registration of Ships, Fishery Vessels and Vessel Registries, approved by Resolution of the Deputy Superintendent of Public Registries No. 022-2012-SUNARP-SA, came into effect.
- Purpose: Establishes rules that are compatible and incorporates the provisions that allow an adequate registry registration considering the entry into force of Legislative Decree No. 1400, which approves the Movable Guarantee Regime.
- Effective as of March 3, 2025.
Supreme Decree Nº 002-2025-EM that optimizes safety in Submarine Lines, Lines to Maritime Terminals, Collection and Injection Systems used in Hydrocarbon activities, located in the Coast and/or in front of the Peruvian coast.
- Purpose: To regulate the orientative control as a measure to optimize safety in the Submarine Lines, Lines to Maritime Terminals, Collection and Injection Systems used in Hydrocarbon activities, located in the coastline and/or in front of the Peruvian coast, in order to ensure compliance with the National Energy Policy of Peru 2010-2040, Supreme Decree No. 064-2010-EM; excluding facilities that exclusively transport natural gas.
- It is established that compliance with the provisions of this regulation is of a priority and exceptional nature.
- A maximum term of 9 months was established for OSINERGMIN to carry out orientative audits in the respective facilities. In the case of Liquefied Petroleum Gas – LPG facilities, the maximum term is 12 months. Said terms are computed as of the entry into force of the guidelines approved by OSINERGMIN.
- A maximum term of 30 working days was established for OSINERGMIN to approve the corresponding technical guidelines, the application of sample inspections and the minimum technical safety conditions (criticality).
- It was established that OSINERGMIN shall report to the General Directorate of Hydrocarbons of the Ministry of Energy and Mines, on a quarterly basis, the result of the indicative inspection actions carried out, according to the type of agent, operating unit, compliance history and risk level; without prejudice to the competences assigned to other entities.
