General Regulations

Recently, the Official Gazette El Peruano published several regulations of interest for the maritime sector, the most relevant aspects of which are summarized below:

Directorial Resolution No. 1029-2024 MGP/DICAPI, which approves the incorporation into national regulations the prescriptions on maintenance, thorough examination, function test, revision and repair of lifeboats and rescue boats, launching devices and release gear, approved with Resolution MSC.402(96) of the IMO Maritime Safety Committee, and dictates other provisions.

  • The incorporation into national regulations of the requirements on maintenance, thorough examination, function test, overhaul and repair of lifeboats and rescue boats, launching devices and release gear, approved with Resolution MSC.402(96) dated May 19, 2016 of the Maritime Safety Committee of the International Maritime Organization (IMO), in compliance with the provisions of regulations III/3 and III/20 of SOLAS 74, is hereby approved.
  • Provided that the amendments to the requirements on the maintenance, survey, functional testing, overhaul and repair of lifeboats and rescue boats, launching appliances and launching appliances adopted by Resolution MSC.559(108) dated 23 May 2024 of the IMO Maritime Safety Committee shall enter into force on 1 January 2026.
  • It is provided that Companies or Owners of national flag vessels shall ensure that the maintenance, survey, test, overhaul and repair on board their vessels are carried out in accordance with the requirements of Article 1 and regulation III/20 of SOLAS 74, as amended, by establishing and implementing health, safety and environmental procedures covering all activities identified in those requirements.
  • It is established that companies authorized to carry out the maintenance and repair of life-saving appliances and means established in Regulation III/20 of SOLAS 74 as amended, shall ensure that the personnel carrying out the maintenance, thorough examination, function test, overhaul and repair of the equipment, have a certification from an authorized service provider. In carrying out such activities on board ships, such personnel shall follow the health, safety and environmental instructions and procedures established by the company.
  • It is provided that national flag vessels shall comply with regulation III/36 of SOLAS 74, as amended, regarding instructions for the maintenance on board of life-saving appliances.
  • Effective: as of March 3, 2025.

Directorial Resolution No. 1054-2024 MGP/DICAPI, approving the incorporation into national standards of four amendments to the International Code for Safety of High Speed Craft 1994 (1994 HSC Code), adopted by the IMO Maritime Safety Committee.

  • The incorporation into national standards of the amendments to the 1994 HSC Code is approved as follows:
    • Resolution MSC.351(92) dated June 21, 2013.
    • Resolution MSC.423(98) dated June 15, 2017.
    • Resolution MSC.438(99) dated May 24, 2018.
    • Resolution MSC.498(105) dated April 28, 2022
  • Provides that the “Unified Interpretations” of the Assembly of the International Maritime Organization are distributed through resolutions of the IMO Committees, which are available on the IMODOCS portal (https://docs.imo.org)
  • Effective: as of March 3, 2025.
