The Securities Market Superintendency («SMV») modifies the «Common Rules for entities requiring authorization to organize and operate the SMV», approved by SMV Resolution No 039-2016- SMV/01 («Standards»). By means of Resolution SMV No. 007-2024-SMV/01 («Resolution»), published in the official journal «El Peruano» on 26 May of this year, that entity approved the amendment of letters j) and m) of Annex B to the Standards, concerning the impediments to being an organizer of the VMS supervised entities referred to by them, and to take certain positions in relation to such supervised entities as a result of the imposition of sanctions.
The change in the wording of the above-mentioned means that, in the case of legal persons who are to become organizers of entities supervised by the SMV referred to in the Rules, or take certain positions in such entities, impediments apply only where the penalty imposed on them has led to the cancellation or revocation of their operating authorisation or any similar measure effects.
