Multi-Sector Commission on Electricity Sector Reform is created

On Thursday, June 20, 2019, Supreme Executive Order No. 006-2019-EM, which the “Multi-Sector Commission on Electricity Sector Reform” (“Commission”) has been created thereby, was published in the Official Gazette “El Peruano”. The purpose of this Commission is to conduct a thorough assessment of the electricity market and the regulatory framework related to the Electricity and Hydrocarbon Subsectors in respect to electric power supply to the Peruvian Interconnected Electric Power System (“SEIN”).

The function of this Commission will be to prepare technical reports containing the following aspects:

(i) Measures leading the Electricity Subsector into standards and international good practices, and ensuring its sustainable development; and

(ii) Proposals in relation to all those improvements being identified as necessary in order to obtain sustainable and efficient operation of the Electricity Subsector subject to the principles of predictability, legal certainty and equality.

For these purposes, the Commission will be composed by five representatives:

(i) Two (2) representatives of the Ministry of Energy and Mines (“MINEM”), one of them being the Vice-Minister of Electricity who will be Chair of this Multi-Sector Commission

(ii) Two (2) representatives of the Supervisory Body of Investment in Energy and Mining (OSINERGMIN)

(iii) One (1) representative of the Ministry of Economy and Finance

Furthermore, it will have a Technical Secretary’s Office whose responsibility will be under the General Division of Electricity. Additionally, four work groups will be created for the power generation, transmission and distribution activities, as well as hydrocarbon activities related to energy supply.

The Commission will be installed within the next days and it will be in force within 24 months from its installation. Upon such term, it should submit a final report to MINEM presenting electricity regulatory framework reform proposals.
