Approval of guidelines for the preparation of the Citizen Participation Plan for the semi-detailed Environmental Impact Studies of the Electricity sub-sector

 

On June 19, 2024, Ministerial Resolution No. 253-2024-MINEM/DM was published in the Official Gazette El Peruano, which approves the Guidelines for the preparation of the Citizen Participation Plan (hereinafter, «PPC») of the semi-detailed Environmental Impact Studies of the Electricity subsector («EIAsd»).

The guidelines develop the provisions of Article 22 of the Citizen Participation Regulation for the performance of Electricity Activities, approved last year by Supreme Decree No. 016-2023-EM, determining that the minimum content of the PPC must include the following:

Project objective: It must be completed in accordance with the characteristics of the project.
Location of the project: In addition to indicating the geopolitical location of the project, it must identify, if applicable, overlaps with areas under any special regulation, recognized by law (i.e., protected natural areas, forestry concessions, archaeological sites, indigenous or native peoples, among others).

Project Description: The description should consider the power and effective area of the project, as well as a map, a list of all its major and ancillary components and describe the current conditions of existing access roads to be used, if any.

Area of influence of the project: The area of preliminary influence or area of influence of the project should be delimited, as appropriate. Likewise, the technical and environmental criteria that support such limitations must be indicated, as well as any overlaps with nearby localities, if applicable.

Stakeholders: Stakeholders are defined as the population involved and/or other organizations related to the project, including those who may be affected by the project (only a list of initial recognition of property owners).

Mechanisms for citizen participation: Details to be included on the mechanisms for citizen participation prior to the preparation of the EIA-sd or its modification (i.e., participatory workshops, among others) and during the evaluation of the EIA-sd or its modification (i.e., participatory workshops, public hearings, among others).

Timeline: The Proprietor must indicate within the chronogram the moments for the execution and culmination of the participation mechanisms indicated in the PPC.

Logistics: The owner should indicate the conditions of the venue where the participatory workshops and the public hearing will be held, as well as the transportation facilities for the stakeholders, if applicable.

Responsible parties: Indicate who is responsible for the citizen participation process on behalf of the Contractor and the Consultant.
Annexes: Maps, signed agreements between parties and other documents.

Finally, it is specified that, in the case of modifications to the PPC, the minimum content developed by the guidelines is applicable as appropriate.
