On July 14, 2025, Resolution No. 128-2025-OS/CD of the Board of Directors was published in the Official Gazette “El Peruano,” approving the “Procedure for the inspection of transmission line easements” (the “New Procedure”). This regulation replaces and repeals in its entirety the previous procedure approved by Resolution No. 264-2005-OS/CD and its amendments.
According to Article 1, the New Procedure entered into force on July 15, 2025.
Below, we list the most relevant aspects:
1. Scope of application
It is clarified that the procedure applies to all transmission lines operated under indefinite concession contracts, including medium voltage lines between 30 kV and less than 60 kV, historically considered part of the transmission system prior to the entry into force of the National Electricity Code.
2. Reinforced definitions
New definitions are incorporated, one of the most important being the incorporation of the term “holder,” making it clear that the New Procedure applies to transmission facilities whether or not they have a definitive concession.
3. New indicator and tolerance for the control of cleared spans (NVS)
The old percentage indicator Ic is replaced by the Number of Cleared Spans (NVS), which sets absolute annual targets according to the range of deficient spans. Minimum tolerances are established with a six-year horizon.
4. New offense classified
An offense is introduced for failing to notify property owners, managers, or occupants of the care and limitations necessary to avoid electrical hazards or accidents, applicable to those who avail themselves of the exceptions.
5. Transitional penalty system
Until a specific scale is approved, offenses will be penalized in accordance with the scale set out in Resolution No. 028-2003-OS/CD.
6. Exception for 2025
The Transitional Supplementary Provisions establish that the reporting obligation will begin on September 1, 2025, on an exceptional basis. From 2026 onwards, all deadlines and obligations must be met, including the annual NVS report.
7. Procedures in progress
Supervision and sanctioning procedures initiated under the 2005 regulations will continue to be governed by those regulations, unless the New Procedure is more favorable. In addition, a maximum period of 180 days is granted to submit complete and standardized baseline information.
