CLOSED FISHING SEASON AND AUTHORIZATIONS

I. Catch limit for the octopus resource in the area of the Guano Islands, Islets and Capes National Reserve System of Peru (RNSIIPG), located in the Province of Ilo, Department of Moquegua was established

 Through Ministerial Resolution No. 00035-2021-PRODUCE published in the Official Gazette “El Peruano”, on February 02, 2021, the catch limit for the octopus resource (Octopus mimus) was established in the area of the Guano Islands, Islets and Capes National Reserve System of Peru (RNSIIPG), located in the Province of Ilo, Department of Moquegua. The catch limit for the octopus resource (Octopus mimus) in 25.1 tons, applied to the extractive activities carried out by artisanal fishing vessels equipped with air compressor with fishing permits in force and by non-industrial fishermen with fishing permits in force, within the area of the Guano Islands, Islets and Capes National Reserve System of Peru (RNSIIPG), located in the Province of Ilo, Department of Moquegua, which will not exceed October 31, 2021, within the framework of the provisions of Ministerial Resolution No. 308-2020-PRODUCE.

II. The Peruvian Sea Institute – IMARPE was authorized to carry out Exploratory Fishery of the Anchovy and White Anchovy Resources in the Southern Zone of the Peruvian Sea

Through Ministerial Resolution No. 00045-2021-PRODUCE published in the Official Gazette “El Peruano”, on February 09, 2021, the Peruvian Sea Institute-IMARPE was authorized to carry out the Exploratory Fishery of the Anchovy (Engraulis ringens) and White Anchovy (Anchoa nasus) Resources in the Southern Zone of the Peruvian Sea using larger-scale purse seine vessels, in order to update the information on the distribution of anchovy, size structure and the incidence of other species in that area. The Exploratory Fishery shall be carried out from 00:00 hours on February 19, for a period of fifteen (15) calendar days, in the maritime area from 16°00′ S to the extreme south, from five (5) nautical miles from the coast.

III. Suspension of anchovy extractive activities in coastal zone

Through Directorial Resolution N° 00031-2021-PRODUCE/DGSFS-PA, published as an extraordinary edition of the Official Gazette “El Peruano”, on February 26, 2021, the suspension of the extractive activities of the Anchovy (Engraulis ringens) and white Anchovy (Anchoa nasus) resource was ordered from 00.00 hours on the day following the publication until the end of the Exploratory Fisheries ordered by the Ministerial Resolution N° 00045-2021-PRODUCE, in the following areas:

– From 16°18’S to 16°26’S and from 73°29’W to 73°46’W of the maritime domain (south of Atico – Arequipa); and.

– From 16°20’S to 16°31’S and 73°21’W to 73°34’W of the maritime domain (south of Atico – Arequipa).

IV. Extractive activities of the horse mackerel resource carried out by larger scale vessels are terminated from 00:00 hours on February 27, 2021

Through Ministerial Resolution No. 00055-2021-PRODUCE published in the Official Gazette “El Peruano”, on February 26, 2021, the extractive activities of the horse mackerel resource (Trachurus murphyi) carried out by larger scale vessels are terminated from 00:00 hours on February 27, 2021. Owners of larger scale vessels may land the Horse Mackerel Resource (Trachurus murphyi), provided that they have authorization to sail before February 27, 2021.

GENERAL REGULATIONS

 I. Model Management Agreement for the Administration of Artisanal Fisheries Infrastructures was amended

 Through Ministerial Resolution Nº 00042-2021-PRODUCE published in the Official Gazette “El Peruano”, on February 09, 2021, paragraph 4.8 of literal “B” of the Fourth Clause, the Sixth Clause and the Seventh Clause of the model Management Agreement for the Administration of Artisanal Fisheries Infrastructures, adopted by Article 2 of Ministerial Resolution Nº 320-2010-PRODUCE and amended by Ministerial Resolution Nº 051-2011-PRODUCE, in accordance with the Annex forming part of this Resolution, were amended.

II. Adoption of the “Technical Health Procedure for the registration of fisheries and aquaculture infrastructures and production areas in official international lists”

 Through Executive Presidency Resolution No. 010-2021-SANIPES/PE published in the Official Gazette “El Peruano”, on February 18, 2021, the “Technical Health Procedure for the registration of fisheries and aquaculture infrastructures and production areas in official international lists” was adopted, based on the grounds set forth in the considerations of this Executive Presidency Resolution. In addition, the Executive Board Resolution N° 043-2018-SANIPES/DE adopting the procedure of “Registration of Fisheries Infrastructures to different Official Lists” and the Executive Board Resolution N° 066-2017-SANIPES/DE in relation to the Official List of production areas authorized by the European Union, are hereby rescinded.

III. Supreme Decree adopted complementary measures to strengthen the fisheries management applicable in the maritime area adjacent to the department of Tumbes

Through Supreme Decree Nº 002-2021-PRODUCE published in the Official Gazette “El Peruano”, on February 19, 2021, complementary measures were adopted to strengthen the fisheries management applicable in the maritime area adjacent to the Department of Tumbes. This Supreme Decree is applicable to (i) shipowners whose fishing vessels are part of the List published by the Regional Directorate of Production of the Regional Government of Tumbes through Board Resolution No. 109-2019/GOB.REG. TUMBES-DRP-DR, and who, until February 10, 2020, have submitted their application for the granting of small-scale fishing permit, and (ii) owners of small-scale fishing vessels who are required to have the technical protocol of health clearance in force granted by the Health Authority, as a condition for the extraction of hydrobiological resources, in accordance with literal c) of Article 7 of Supreme Decree No. 011-2019-PRODUCE. In addition, it is provided to repeal the First Transitional Complementary Provision of Supreme Decree No. 011-2019-PRODUCE, Supreme Decree that establishes provisions to strengthen fisheries management measures applicable in the maritime area adjacent to the Department of Tumbes.

IV. Provide that the determination of factors of hydrobiological resources or products seized for direct human consumption and hydrobiological products seized for indirect human consumption is carried out by the General Office of Impact Assessment and Economic Studies of the Ministry

Through Executive Presidency Resolution No. 00052-2021-PRODUCE published in the Official Gazette “El Peruano”, on February 24, 2021, it is provided that the determination of factors of hydrobiological resources or products seized for direct human consumption and hydrobiological products seized for indirect human consumption applicable to seizure procedures, as referred to in Articles 48 and 49 of the Regulation on the Control and Sanction of Fisheries and Aquaculture Activities, adopted by Supreme Decree No. 017-2017-PRODUCE, is carried out by the General Office of Impact Assessment and Economic Studies of the Ministry of Production. The General Office for Impact Assessment and Economic Studies publishes, within five (5) working days prior to the beginning of each month, the factor hydrobiological resources or products seized for direct human consumption and hydrobiological products seized for indirect human consumption on the Institutional Portal of the Ministry of Production (www.gob.pe/produce) and through the computer tools developed by the General Office of Information Technologies.

V. Supreme Decree repealing paragraph 102 of Article 134 of the Regulations of the General Fisheries Law, adopted by Supreme Decree No. 012-2001-PE and code 102 of the Table of Sanctions of the Regulations on Inspection and Sanction of Fishery and Aquaculture Activities, adopted by Supreme Decree No. 017-2017-PRODUCE

Through Supreme Decree No. 005-2021-PRODUCE published in the Official Gazette “El Peruano”, on February 25, 2021, paragraph 102 of Article 134 of the Regulations of the General Fisheries Law, adopted by Supreme Decree No. 012-2001-PE and code 102 of the Table of Sanctions of the Regulations on Inspection and Sanction of Fishery and Aquaculture Activities, adopted by Supreme Decree No. 017-2017-PRODUCE, are repealed.

VI. Provide for the publication of the draft “Supreme Decree amending the Regulations of the General Law of Aquaculture, adopted by Supreme Decree No. 003-2016-PRODUCE and the Regulations on Inspection and Sanction of Fishery and Aquaculture Activities, adopted by Supreme Decree No. 017-2017-PRODUCE”

Through Ministerial Resolution No. 00056-2021-PRODUCE published in the Official Gazette “El Peruano”, on February 27, 2021, provides for the publication of the draft “Supreme Decree amending the Regulations of the General Law on Aquaculture, adopted by Supreme Decree No. 003-2016-PRODUCE and the Regulations on Inspection and Sanction of Fishery and Aquaculture Activities, adopted by Supreme Decree No. 017-2017-PRODUCE”, as well as its Statement of Motives, on the Institutional Portal of the Ministry of Production (www. gob.pe/produce), the same day of the publication of this Ministerial Resolution in the Official Gazette El Peruano, for a period of ten (10) calendar days, counted from February 28, 2021 for the purpose of receiving opinions, comments and/or suggestions from public, private and general public entities.
