I. MODIFICATION OF JACK MACKEREL CATCH LIMIT FOR 2024
By means of Ministerial Resolution N° 285-2024-PRODUCE published on July 13, 2024 in the Official Gazette “El Peruano”, Article 1 of Ministerial Resolution N° 449-2023-PRODUCE was modified in relation to the jack mackerel catch limit for 2024, setting it at 204,000 tons. Of this quota, 84,000 correspond to the larger scale fleet, 100,000 to the artisanal fleet from 20 m3 to 32.6 m3, 14,375 to the artisanal fleet smaller than 20 m3 and 5,625 to the curtain fleet and other passive fishery gears.
II. THE FIRST ANCHOVY FISHERY SEASON IN THE NORTH-CENTRAL ZONE IS TERMINATED
By Ministerial Resolution N° 289-2024-PRODUCE published on July 17, 2024 in the Official Gazette “El Peruano”, the first anchovy fishery season in the North Central zone in the maritime area between the northern end of the maritime domain and 16°00’S was terminated as of 00.00 hours of the day following the publication of the resolution. Unloading and processing are allowed up to 24 and 48 hours, respectively, after the end of the season.
III. MACKEREL CATCH LIMIT FOR 2024 IS MODIFIED
By means of Ministerial Resolution N° 290-2024-PRODUCE published on July 19, 2024 in the Official Gazette “El Peruano”, Article 2 of Ministerial Resolution N° 449-2023-PRODUCE was modified in relation to the catch limit of the mackerel resource for 2024, establishing it at 63,000 tons. Of this quota, 25,991 correspond to the larger scale fleet, 31,533 to the artisanal fleet from 20 m3 to 32.6 m3, 3,895 to the artisanal fleet smaller than 20 m3 and 1,581 to the curtain fleet and other passive fishery gears.
IV. IMARPE IS AUTHORIZED TO CARRY OUT AN EXPLORATORY FISHERY OF THE BONITO RESOURCE
By means of Ministerial Resolution N° 300-2024-PRODUCE published on July 24, 2024 in the extraordinary edition of the Official Gazette “El Peruano”, an exploratory fishery of the bonito resource in the national maritime area was authorized as of 00.00 hours of the day after the resolution was published. The term is 30 calendar days or until the quota of 1,500 tons allowed in this exploratory fishery is reached. This exploratory fishery is carried out with artisanal fishery vessels of up to 10 m3 of hold capacity.
I. GUIDELINES FOR THE ALLOCATION OF THE PERUVIAN JACK MACKEREL QUOTA ON THE HIGH SEAS ARE MODIFIED
By Ministerial Resolution N° 280-2024-PRODUCE published on July 3, 2024 in the Official Gazette “El Peruano”, some aspects of the “Guidelines for the allocation of the high seas jack mackerel quota conferred to the Peruvian State by the South Pacific Regional Fisheries Management Organization, which were approved by RM 418-2019-PRODUCE, were modified.
It is provided that if by the second week of August of each year, national shipowners do not extract at least 50% of the high seas jack mackerel quota, the unused surplus will be allocated to owners of foreign flag vessels through public tender. Likewise, the remaining quota will be allocated to owners of foreign flag vessels, if by the last working day of August of each year, the national shipowners do not extract at least 80% of the quota. The Ministry of Production, through a notice published in its digital headquarters, may indicate dates other than those indicated for a given period, for the purpose of verifying the percentages of utilization of the allocated quota.
Finally, and in relation to the assumptions for the installation of the Special Committee in charge of carrying out the public bidding, the date for the installation is modified to September 1 of each year in the case of verifying possible surpluses of the quota not fully used by national shipowners until the end of the year.
II. REGULATIONS OF THE SATELLITE MONITORING SYSTEM ARE MODIFIED
By Supreme Decree N° 009-2024-PRODUCE, published in the Official Gazette “El Peruano” on July 12, 2024, the Regulation of the Satellite Monitoring System for fishery vessels (SISESAT), approved by Supreme Decree N° 001-2014-PRODUCE, was amended in order to promote the access of natural or legal persons to the List of Apt Satellite Providers, in order to have technological alternatives of satellite equipment for the benefit of fishery vessel owners.
III. MINIMUM TECHNICAL SPECIFICATIONS OF THE SATELLITE TRACKING SYSTEM REGULATIONS ARE MODIFIED
By Ministerial Resolution N° 282-2024-PRODUCE published on July 12, 2024 in the Official Gazette “El Peruano”, Annex 2 “Minimum Technical Specifications” of the Regulation of the Satellite Monitoring System for Fishery Vessels (SISESAT), approved by Supreme Decree N° 001-2014-PRODUCE, was amended.
Likewise, it is established that artisanal fishery vessels obliged to have satellite equipment may continue to operate with their current operational equipment until the next change or installation of satellite tracking equipment or other alternative tracking system, according to the aforementioned amended Annex 2.
IV. CONSTITUTE THE COMMISSION IN CHARGE OF PREPARING THE BASES AND TERMS FOR THE SELECTION PROCESS OF THE SUPERVISING COMPANIES THAT WILL EXECUTE THE SURVEILLANCE AND CONTROL PROGRAM OF FISHERY AND AQUACULTURE ACTIVITIES FOR THE PERIOD 2025-2028
By means of Ministerial Resolution N° 291-2024-PRODUCE published on July 19, 2024 in the Official Gazette “El Peruano”, the Commission in charge of preparing the bases and terms of reference for the call and conduction of the selection process of the supervising companies that will execute the Surveillance and Control Program of fishery and aquaculture activities at the national level was constituted, in the period from January 1, 2025 to December 31, 2028, which will be integrated by one titular member and one alternate member from the following general directorates and offices of the Ministry of Production.
During the execution of the public events, two representatives of the most representative business associations that assume the financing of the Program may be invited to act as observers.
V. LAW AMENDING THE ORGANIC LAW OF REGIONAL GOVERNMENTS AND THE ORGANIC LAW OF MUNICIPALITIES TO EXPAND FUNCTIONS IN FISHERY MATTERS WAS ENACTED.
By means of Law N° 32096 published in the Official Gazette “El Peruano” on July 20, 2024, Articles 52 of Law N° 27867 – Organic Law of Regional Governments and 73 of Law N° 27972 – Organic Law of Municipalities, were amended to incorporate the power to formulate, approve, declare feasibility and execute investment projects in aquaculture matters, which are aligned with the National Aquaculture Policy on artisanal fishery landings. For such executions, compliance with the current regulations on the matter and the guidelines approved by FONDEPES, which maintains its investment competencies in accordance with its sectoral policy, is required.
I. DIRECTOR OF THE DIRECTORATE OF AQUACULTURE MANAGEMENT APPOINTED
By means of Ministerial Resolution N° 277-2024-PRODUCE published in the Official Gazette “El Peruano” on July 2, 2024, Mr. Juan Tomás Macazana Tello was appointed as Director of the Directorate of Aquaculture Management of the General Directorate of Aquaculture of the Vice-Ministerial Office of Fisheries and Aquaculture of the Ministry of Production.
