CLOSED SEASON AND AUTHORIZATIONS

I. Suspension of anchovy and longnose anchovy resources fishing activities in coastal zone

Pursuant to Ministerial Order No. 303-2019-PRODUCE published in the Official Gazette “El Peruano” on July 6, 2019, it is set forth to suspend fishing activities of anchovy (Engraulis ringens) and longnose anchovy (Anchoa nasus) resources as of 00:00 hours, July 8, 2019 for 10 calendar days as per the following details: a) Between 05°30’S and 08°00’S, and b) Between 12°00’S and 15°59’S.

II. Setting Total Maximum Catch Limit for Direct Human Consumption (LMTC-CHD) of anchovy resource for 2019 corresponding to the whole coastline

Pursuant to Ministerial Order No. 313-2019-PRODUCE published in the Official Gazette “El Peruano” on July 18, 2019, it is set forth to set the Total Maximum Catch Limit for Direct Human Consumption (LMTC-CHD) of anchovy resource for 2019 to 150,000 tons corresponding to the whole coastline, pursuant to the Direct Human Consumption Anchovy Fisheries Management Regulation, Section 9, approved by Supreme Executive Order No. 005-2017-PRODUCE and its amendments. That amount shall be exclusively for direct human consumption. The termination date of fishing activities shall be once said LMTC-CHD will be reached, or otherwise, when the Marine Institute of Peru (IMARPE) will give advice due to environmental or biological circumstances.

III. Establishing temporary measures for bonito conservation and fisheries management; as well as change of the minimum catch size and the percentage of maximum tolerance for juvenile bonito bycatch

Pursuant to Ministerial Order No. 321-2019-PRODUCE published in the Official Gazette “El Peruano” on July 23, 2019, it is set forth to establish temporary measures for conservation and fisheries management of bonito (Sarda chiliensis chiliensis); as well as to change the minimum catch size and the percentage of maximum tolerance for juvenile bonito bycatch. This provisions are applied to fishing activities regarding such resource conducted by artisanal fishing vessels holding a fishing permit in effect and those being authorized by the administrative right, from 00:00 hours, July 24, 2019 to December 31, 2019 along the whole Peruvian coastline. It is also set forth that the catch limit of said schedule is such provided for by Ministerial Order No. 003-2019-PRODUCE. Finally, it is set forth that the Ministry of Production shall terminate the fishing activity of bonito (Sarda chiliensis chiliensis) when the quota provided for by Ministerial Order No. 003-2019-PRODUCE will be reached or, otherwise, on December 31, 2019.

IV. Providing addition of Artisanal Landing Port “Cabo Blanco” in the Authorized Landing Point List within the framework of the Hake Resource Exploratory Fishery authorized by virtue of Ministerial Order No. 317-2019-PRODUCE

Pursuant to Director’s Order No. 130-2019-PRODUCE/DGSFS-PA published in the Official Gazette “El Peruano” on July 24, 2019, it is set forth to add Artisanal Landing Port “Cabo Blanco” in the Authorized Landing Point List within the framework of the Hake Resource Exploratory Fishery authorized by virtue of Ministerial Order No. 317-2019-PRODUCE.

V.Authorizing the commencement of the 2019 Second Fishing Season of anchovy and longnose anchovy resources in the Southern Zone of Peru

Pursuant to Ministerial Order No. 324-2019-PRODUCE published in the Official Gazette “El Peruano” on July 25, 2019, it is set forth to authorize the commencement of the Second Fishing Season of anchovy (Engraulis ringens) and longnose anchovy (Anchoa nasus) in the maritime area between 16°00’LS and the southern end of the maritime domain of Peru, corresponding to the term July-December 2019. The commencement of the Second Fishing Season shall govern as of 00:00 hours of the fourth business day from July 26, 2019 until the Total Maximum Allowable Catch Limit being 540,000 tons will be reached, or otherwise, on December 31, 2019.

VI. Termination of the 2019 First Fishing Season of anchovy and longnose anchovy resources corresponding to the Northern-Center Zone of Peru

Pursuant to Ministerial Order No. 329-2019-PRODUCE published in the Official Gazette “El Peruano” on July 29, 2019, it is set forth to terminate the 2019 First Fishing Season of anchovy (Engraulis ringens) and longnose anchovy (Anchoa nasus) corresponding to the Northern-Center Zone in the maritime area between the northen end of the maritime domain of Peru and 16°00’LS, from 0:00 hours, July 31, 2019.

GENERAL REGULATIONS

I. Supreme Executive Order amending Sections 43 and 45 of the Regulation of the General Fishery Act, approved by Supreme Executive Order No. 012-2001-PE

Pursuant to Supreme Executive Order No. 007-2019-PRODUCE published in the Official Gazette “El Peruano” on July 10, 2019, it is set forth to amend the first paragraph of Subsection 43.2; Section 43, Subsection 43.3; and Section 45, Subsection 45(a) of the Regulation of the General Fishery Act, approved by Supreme Executive Order No. 012-2001-PE, as follows:

“Section 43. Default on fishing fee payment and expiration of fishing permit

43.2. The General Division of Fishery for Direct and Indirect Human Consumption verifies semiannually the enforcement compliance with fishing fee payments in February (payment corresponding to July-December term) and August (payment corresponding to January-June term) (…).

43.3. In the event of default, the General Division of Fishery for Direct and Indirect Human Consumption issues, in every March and September, a Director’s Order by setting forth the suspension of fishing permits and the starting of fishing permit expiration procedure, if applies (…).”

“Section 45. Amount of Fishing Fees for Hydrobiological Resources Harvesting.

  1. a) Fee payment for indirect human consumption hydrobiological resources harvesting is made on 0.43% FOB value per ton of fish meal calculated on the monthly average price as per official information issued by ADUANET (…)”

II. Approval of Peruvian Technical Standards, version 2019 referred to fish blocks of fillets and frozen minced meat, animal food and others

Pursuant to Director’s Order No. 009-2019-INACAL/DN published in the Official Gazette “El Peruano” on July 12, 2019, it is set forth to approve Peruvian Technical Standards, version 2019.

 III. Approval of Regulation of Act No. 30063, Peruvian Administration of Fishery Health (SANIPES) Creation Act

Pursuant to Supreme Executive Order No. 010-2019-PRODUCE published in the Official Gazette “El Peruano” on July 14, 2019, it is set forth to approve the Regulation of Act No. 30063, Peruvian Administration of Fishery Health (SANIPES) Creation Act.

IV. Approval of list of species related to tuna resource to be applied to longline fishing activities

Pursuant to Ministerial Order No. 323-2019-PRODUCE published in the Official Gazette “El Peruano” on July 24, 2019, it is set forth to approve the list of species related to tuna resource to be applied to longline fishing activities within the framework of the Third Final Supplementary Provision of the Tuna Fisheries Management Regulation, approved by virtue of Supreme Executive Order No. 032-2003-PRODUCE and its amendments. Likewise, it is set forth to approve those provisions under Section 3, Subsection 3.1 of said Regulation.

V. Supreme Executive Order establishing provisions to strengthen fisheries management measures applicable to the maritime area contiguous to the Department of Tumbes

Pursuant to Supreme Executive Order No. 011-2019-PRODUCE published in the Official Gazette “El Peruano” on July 26, 2019, it is set forth to establish provisions to strengthen fisheries management measures applicable to the maritime area contiguous to the Department of Tumbes.

APPOINTMENTS

I. Appointment of member of the Board of Directors of SANIPES, representing the Ministry of Health

Pursuant to Supreme Executive Resolution No. 013-2019-PRODUCE published in the Official Gazette “El Peruano” on July 9, 2019, it is set forth to appoint Cedilia Victoria Akemi Kuroiwa Pérez, representative of the Ministry of Health as a member of the Board of Directors of SANIPES.

II. Appointment of members of the First and Second Temporary Specialized Unit of Fishery; of the Specialized Unit of Industry; of the Temporary Specialized Single-Member Unit of Fishery of the Board of Appeal on Sanctions, Ministry of Production

Pursuant to Ministerial Order No. 327-2019-PRODUCE published in the Official Gazette “El Peruano” on July 27, 2019, it is set forth to appoint the following persons, effectively as of August 1, 2019: Dante Francisco GIRIBALDI MEDINA as full member of the Second Temporary Specialized Unit of Fishery, Board of Appeal on Sanctions, Ministry of Production; Fiorella Giulliana NOYA MAGGIOLO DE MANRIQUE as full member of the Specialized Unit of Industry and alternate member of the First Temporary Specialized Unit of Fishery, Board of Appeal on Sanctions, Ministry of Production; and Jean Pierre Andre MOLINA DIMITRIJEVICH as alternate member of the Temporary Specialized Single-Member Unit of Fishery, Board of Appeal on Sanctions, Ministry of Production. All positions shall be performed in addition to those currently being performed.
