CLOSED FISHERY SEASON AND AUTHORIZATIONS

I. The catch quota for the bonito resource established by R.M. No. 002-2020-PRODUCE was amended

Through Ministerial Resolution No. 00293-2020-PRODUCE published in the Official Gazette “El Peruano” on September 3, 2020, the first paragraph of paragraph 1.1 of Article 1 of Ministerial Resolution No. 002-2020-PRODUCE, as amended by Ministerial Resolution No. 126-2020-PRODUCE, was amended to read as follows: “Article 1. – Establishment of the catch limit for the bonito resource 1.1 Establish the catch limit for the bonito resource (Sarda chiliensis chiliensis) for the period 2020, at eighty-eight thousand (88,000) tons, applicable to the extractive activities carried out by artisanal vessels and those vessels whose administrative law authorizes it (…)”.

II. The Peruvian Sea Institute – IMPARPE was authorized to carry out Exploratory Fishery for mackerel resource in order to determine the by-catch of the horse mackerel resource

Through Ministerial Resolution No. 297-2020-PRODUCE published in the Official Gazette “El Peruano” on September 4, 2020, the Peruvian Sea Institute – IMARPE was authorized to carry out an Exploratory Fishery of the mackerel resource (Scomber japonicus peruanus), with the participation of larger scale vessels, in order to determine the by-catch of the horse mackerel resource (Trachurus murphyi), starting at 00:00 hours: 00 hours on September 16 of the current year, for a period of ten (10) calendar days, or when the catch limit established in Ministerial Resolution No. 025-2020-PRODUCE is reached, extended by Ministerial Resolution No. 123-2020-PRODUCE, or when IMARPE recommends it for reasons of conservation of the aforementioned resources. The period established may be amended according to the recommendations of IMARPE.

III. A reproductive closure of the hake resource in the maritime area was established and other provisions were enacted

Through Ministerial Resolution No. 00299-2020-PRODUCE published in the Official Gazette “El Peruano” on September 6, 2020, the reproductive closure of the hake resource (Merluccius gayi peruanus) was authorized in the maritime area between 04°00’S and 05°00’S of the Peruvian maritime domain. Consequently, it was prohibited the extraction of the mentioned resource, for all type of fleet, from 00:00 hours on September 07, 2020 for a period of thirty five (35) calendar days. Likewise, the reproductive closure of the Hake resource (Merluccius gayi peruanus) was established in the maritime area between the northern border of the Peruvian maritime domain and the 04°00’S. Consequently, the extraction of the mentioned resource was prohibited, for all type of fleet, from 00:00 hours on September 07, 2020, for a period of thirty five (35) calendar days.

IV. The period of reproductive closure of the choro hydrobiological resource in the Peruvian coast, between the months of September and November was established for each year

Through Ministerial Resolution No. 00309-2020-PRODUCE published in the Official Gazette “El Peruano” on September 18, 2020, the period of reproductive closure of the choro hydrobiological resource (Aulacomya atra) in the Peruvian coast, between the months of September and November was established for each year. This period, the beginning and end date shall be subject to the recommendation made by the Peruvian Sea Institute – IMARPE, based on the evolution of the critical values of the reproductive index of the referred resource. For the year 2020, the period of reproductive closure of the choro hydrobiological resource (Aulacomya atra) in the Peruvian coast, was established from 00:00 hours of September 20 for a period of fifty-six (56) calendar days; being prohibited all extractive activity that involves this species, as well as, its transport, commercialization and/or storage. The transport, placing on the market and/or storage may be carried out provided that there is clear documentation of a certain date showing that the resource has been removed before the date of prohibition.

V. Reproductive closure of the pejerrey hydrobiological resource in the Peruvian coast was established for the year 2020

Through Ministerial Resolution Nº 00314-2020-PRODUCE published in the Official Gazette “El Peruano” on September 19, 2020, the reproductive closure of the pejerrey hydrobiological resource (Odontesthes regia) in the Peruvian coast was established for the year 2020, from 00:00 hours on September 21, 2020, being prohibited all extractive activity that involves this species, as well as its processing, transport, commercialization and/or storage; unless there is unquestionable documentation and of certain date showing that the referred resource has been extracted before the date of prohibition. The completion of this reproductive closure shall be arranged, prior report of the Peruvian Sea Institute – IMARPE, through the issuance of the respective Ministerial Resolution.

VI. Authorization to transfer financial resources to the Peruvian Sea Institute – IMARPE

Through Ministerial Resolution No. 00318-2020-PRODUCE published in the Official Gazette “El Peruano” on September 25, 2020, the transfer of financial resources from Executing Unit 001: Ministry of Production was authorized, in favor of the Peruvian Sea Institute – IMARPE, up to the sum of S/.172 098,00 (ONE HUNDRED SEVENTY-TWO THOUSAND NINETY-EIGHT AND 00/100 SOLES), from the resources collected for Fishery Rights, in the Source of Financing Resources Directly Collected, for the execution of the following activity: “Biological monitoring of fan shell (Argopecten purpuratus) resource for aquaculture production in the area of Callao (2020)”.

VII. The execution period of the exploratory fishery was amended

Through Ministerial Resolution No. 00319-2020-PRODUCE published in the Official Gazette “El Peruano” on September 25, 2020, the first paragraph of Article 1 of Ministerial Resolution No. 297-2020-PRODUCE was amended to read as follows “Authorize the Peruvian Sea Institute – IMARPE to carry out an exploratory fishery of the mackerel resource (Scomber japonicus peruanus), with the participation of larger scale vessels, in order to determine the by-catch of the horse mackerel resource (Trachurus murphyi), from 00:00: 00 hours on September 16 of the current year, for a period of twenty (20) calendar days, or when the catch limit established in Ministerial Resolution No. 025-2020-PRODUCE is reached, extended by Ministerial Resolution No. 123-2020-PRODUCE, or when IMARPE recommends it for reasons of conservation of the mentioned resources (…)”.

GENERAL REGULATIONS

I. “Technical Health Procedure for the emission or amendment of the technical protocol of health qualification of the fishery and aquaculture infrastructures” was adopted

Through Executive Presidency Resolution No. 062-2020-SANIPES/PE published in the Official Gazette”El Peruano” on September 5, 2020, the Executive Directorate Resolution No. 042-2018-SANIPES-DE, which adopts the Procedure “Health Care for Fisheries and Acquaculture Infrastructure Health Clearance Services” (P01-SDHPA-SANIPES) and the “Technical Health Procedure for the emission or amendment of the technical protocol for health clearance of fisheries and aquaculture infrastructures”, was adopted.

II. Authorized weighing instruments and their technical requirements for the weighing of the anchovy and white anchovy hydrobiological resources in plants processing fishery products for indirect human consumption with high protein content are established

Through Ministerial Resolution Nº 00296-2020-PRODUCE published in the Official Gazette “El Peruano” on September 6, 2020, the authorized weighing instruments and their technical requirements for the weighing of the anchovy and white anchovy hydrobiological resources in plants of processing fishery products for indirect human consumption with high protein content are established, in accordance with Annexes 1, 2, and 3 of the referred resolution. This standard is applicable to the licensees of operation of processing plants of fishery products for indirect human consumption of high protein content.

III. The Operations Manual of the National Program “A Comer Pescado” was adopted

Through Ministerial Resolution No. 292-2020-PRODUCE published in the Official Gazette “El Peruano” on September 8, 2020, the Operations Manual of the National Program “A Comer Pescado” was adopted, consisting of three (03) titles, eight (08) chapters, thirty-nine (39) Articles and one (01) Annex – Organization Chart.

IV. Authorized weighing instruments and their technical requirements are established for the weighing of hydrobiological resources, residues, discards and raw material not considered for processing by size selection, weight or quality from the anchovy resource, and other provisions are enacted

Through Ministerial Resolution No. 303-2020-PRODUCE published in the Official Gazette “El Peruano” on September 9, 2020, the authorized weighing instruments and their technical requirements are established for the weighing of hydrobiological resources, residues, discards, and raw material not considered for processing by size selection, weight or quality from the anchovy resource, in plants of processing of industrial fishery products for direct human consumption, plants of residual flour, plants of reuse, plants of processing for marine macroalgae hydrobiological resources and artisan plants for direct human consumption, in accordance with annexes 1,2,3 and 4 of the referred resolution.

V. Conservation and management measures for the sustainable use of the octopus resource in the System of Islands, Islets and Guanera Points National Reserve – Punta Coles (RNSIIPG-Punta Coles), located in the province of Ilo, department of Moquegua, have been adopted

Through Ministerial Resolution Nº 00308-2020-PRODUCE published in the Official Gazette “El Peruano” on September 12, 2020, the conservation and management measures for the sustainable use of the octopus resource (Octopus mimus) in the in the System of Islands, Islets and Guanera Points National Reserve – Punta Coles (RNSIIPG-Punta Coles), located in the province of Ilo, department of Moquegua, have been adopted. The extractive activity of the octopus resource (Octopus mimus) in the area of the RNSIIPG-Punta Coles, shall start from 00:00 hours of the working day after the publication of the Resolution of the Regional Management of the Production of the Regional Government of Moquegua – GERPRO Moquegua, which adopts the list elaborated in coordination with the National Service of Natural Areas Protected by the State – SERNANP of the Ministry of the Environment, referred in the Article 9 of the aforementioned Ministerial Resolution.

VI. Supreme Decree adopting the provision of services offered exclusively by the National Agency for Fisheries Health (SANIPES) related to the export of hydrobiological resources and products, and feeds for use in aquaculture

Supreme Decree No. 017-2020-PRODUCE published in the Official Gazette “El Peruano” on September 16, 2020, adopts the provision of services provided exclusively by the National Agency for Fisheries Health (SANIPES), related to the export of hydrobiological resources and products, and feed for use in aquaculture, with the following: a) Certificate of free sale, b) Health Certificate for Export purposes, and c) Application for registration of fishery or aquaculture infrastructure or production areas, with the health authorities of foreign countries, for export purposes.

VII. Supreme Decree repealing the Third Final Provision of the Regulations to the General Fisheries Act, adopted by Supreme Decree No. 012-2001-PE

Through Supreme Decree No. 018-2020-PRODUCE published in the Official Gazette “El Peruano” on September 24, 2020, the Third Final Provision of the Regulations to the General Fisheries Act, adopted by Supreme Decree No. 012-2001-PE, was repealed.

VIII. Draft of Regulations on Fisheries and Aquaculture Health Infringements and Sanctions is published by SANIPES for the opinion of the interested parties

Through Executive Presidency Resolution No. 065-2020-SANIPES/PE published on the website of the entity on September 25, 2020, was published for the opinion of any interested party and within 30 calendar days, the draft of “Regulations on Fisheries and Aquaculture Health Infringements and Sanctions ” of the National Agency of Fisheries Health – SANIPES. APPOINTMENTS

I. General Director of Training and Technical Development in Artisanal Fisheries of the National Fund for Fisheries Development was appointed

Through Resolution No. 080-2020-FONDEPES/J published in the Official Gazette”El Peruano” on September 1, 2020, Mr. Jorge Luis Natividad Henostroza was appointed as General Director of Training and Technical Development in Artisanal Fisheries of the National Fund for Fisheries Development.

II. Director of the Monitoring and Evaluation Directorate of the General Directorate for Policy and Regulatory Analysis in Fisheries and Aquaculture of the Vice Ministry of Fisheries and Aquaculture was appointed

Through Ministerial Resolution No. 00291-2020-PRODUCE published in the Official Gazette “El Peruano” on September 1, 2020, Ms. Dalia Rosa Chang Valdez was appointed as Director of the Monitoring and Evaluation Directorate of the General Directorate for Policy and Regulatory Analysis in Fisheries and Aquaculture of the Vice Ministry of Fisheries and Aquaculture of the Ministry of Production

III. Director of the National Agency for Fisheries Health – SANIPES was appointed

Corrected in an erratum notice of the Resolution of the Executive Presidency No. 061-2020-SANIPES/PE published in the Official Gazette “El Peruano” on September 2, 2020, the lawyer Roberto Arcenio López Baca was appointed as Director of the Sanctions Directorate of the National Agency for Fisheries Health – SANIPES, as provided for in the Table for the Assignment of Provisional Personnel (Provisional CAP), as an Employee of Trust of the Entity.

IV. Coordinator of Engineering Studies and functions of Coordinator of Formulation and Evaluation of Projects of the General Directorate for Artisanal Fisheries and Aquaculture Investment of FONDEPES was appointed

Through Chief Resolution No. 089-2020-FONDEPES/J published in the Official Gazette “El Peruano” on September 9, 2020, Mr. Dennis Ronald Cupe Cure was appointed to the position of Coordinator of Engineering Studies of the General Directorate of Artisanal Fisheries and Aquaculture Investment of FONDEPES and Mr. Dennis Ronald Cupe Cure was appointed to the position of Coordinator of Formulation and Evaluation Projects of the General Directoarte for Artisanal Fisheries and Aquaculture Investment of FONDEPES, until the hiring process of the holder of such position is completed.

V. General Director of the General Directorate for Supervision, Control and Sanction of the Vice-Ministerial Office for Fisheries and Aquaculture was appointed

Through Ministerial Resolution Nº 00310-2020-PRODUCE published in the Official Gazette”El Peruano” on September 16, 2020, Mr. Luis Alberto Alfaro Garfias was appointed as General Director of the General Directorate for Supervision, Control and Sanction of the Vice-Ministerial Office for Fisheries and Aquaculture of the Ministry of Production.

VI. Chief of the General Office for the Administration of FONDEPES was appointed

Through Chief Resolution No. 090-2020-FONDEPES/J published in the Official Gazette “El Peruano” on September 19, 2020, Mr. Luis Aquiles Fernández Araujo was appointed as Chief of the General Office for the Administration of FONDEPES.

VII. General Manager of the National Agency for Fisheries Health – SANIPES was appointed

Through Executive Presidency Resolution No. 066-2020-SANIPES/PE published in the Official Gazette” El Peruano” on September 27, 2020, industrial engineer Juan Francisco Córdova Pintado was entrusted with the duties of General Manager of the National Agency for Fisheries Health – SANIPES, in addition to the duties he has been performing as Advisor 1 to the Executive Presidency, from September 28, 2020 until the appointment of the new General Manager.
