INDECOPI publishes «Guidelines for the implementation of the Programme for the accelerated procedure for examining patent applications in the green technologies sector, Non-polluting technologies or environmentally sustainable technologies (Accelerated Green Patent Programme).»

 

By resolution No. 001160-2024/DIN-INDECOPI of 19 April 2024, The INDECOPI Directorate for Inventions and New Technologies published the Guidelines for the implementation of the Programme for the accelerated procedure for examining patent applications belonging to the green technologies sector, Non-polluting technologies or environmentally sustainable technologies (Accelerated Green Patent Programme).

The requirements for eligibility under the Programme are as follows:

(i) Patent applications (by which we mean patents of invention and utility models) filed as of 2 January 2023 (including PCT applications in the national phase).

(ii) Patent applications with the main classification (first order) of one of the groups of the International Patent Classification (IPC) The sectors mentioned in the International Patent Classification (IPC) Green Inventory are:

Production of alternative energy sources
Transport
Energy conservation
Waste management
Agriculture / forestry
Administrative, regulatory or design aspects
Nuclear power generation
(iii) The patent application must have been published, the time limit for filing objections has expired and the applicant must have applied for and paid the fee for substantive examination.

(iv) The Directorate for Inventions and New Technologies must not have notified a patentability examination of the application.

Divisional patent applications will also be eligible for the Accelerated Green Patent Program. The applicant may submit a new application to participate in the Program in the divisional application and comply with all conditions set forth in the Guidelines.

The Accelerated Green Patent Program is free and started on May 2, 2024.
