23 August 2023 is the deadline for auditing the occupational health and safety management system

This was stipulated in Article 8.2 of Legislative Decree Nº 1499, which temporarily suspended some occupational safety and health obligations due to the Health Emergency (ES).

According to this provision, once the ES has ended (25 May 2023), employers are obliged to carry out audits of the Occupational Safety and Health Management System (SGSST) within the following ninety calendar days.  This deadline expires on 23 August 2023.

The audit report must be submitted to the competent authorities within 15 calendar days of the issuance of the audit report.

It should be recalled that all employers with more than 10 workers are obliged to periodically carry out audits of their OSHMS.  In the case of risk activities, the audit is carried out every two years, while in the case of non-risk activities, the audit is carried out every three years.  Some economic activities with specific sectoral regulations on occupational safety and health have shorter deadlines (in mining, for example, audits are carried out annually).
