Amendment of the Schedule of adequacy and GPS registration of the Transport or Distribution Units of LPG in bulk registered in the Hydrocarbons Registry was adopted

Through OSINERGMIN Board of Directors Resolution No. 018-2021-OS/CD, published in the Official Gazette El Peruano, on January 30, 2021, the Schedule adopted by OSINERGMIN Board of Directors Resolution Nº 197-2020-OS/CD for the adequacy and GPS registration of LPG Transport Units (tank trucks and tankers) registered in the Hydrocarbons Registry (“RHO“) (“Schedule“) was amended. This, in order to allow them to adapt in timely manner to the Single Ordered Text of the Regulation on the Use of Global Positioning Systems, adopted by Board of Directors Resolution No. 076-2014-OS-CD (“TUO GPS”), and to maintain their authorization in the Purchase Order Control System (“SCOP“).

In order to carry out the aforementioned adequacy, through Board of Directors Resolution No. 030-2020-OS/CD, OSINERGMIN adopted the “Procedure for re-registration in the Hydrocarbons Registry of agents that carry out LPG transport and distribution activities through Tank Trucks and Tanker Trucks” and the “Schedule for the submission of applications for re-registration in the Hydrocarbons Registry”. According to OSINERGMIN, the re-registration activities should have taken place between July and December 2020; however, the restrictions to free transit stemming from the National State of Emergency forced to postpone them for the period from November 2020 to April 2021.

It should be noted that failure to comply with the provisions related to re-registration, adequacy and registration could result in the cancellation of the RHO registration or disqualification of the agent in the SCOP.

Given the new restrictions on free transit issued by the State to prevent the increase of COVID-19 cases in certain departments of the country, the holders of Transport Units used for the transport or distribution of LPG in bulk shall not be able to comply with the above-mentioned provisions.

In order to avoid the cancellation of the registration of such units in the RHO or their disqualification in the SCOP, it has been deemed necessary to modify the Schedule and postpone the adaptation and registration activities for the period from April to September 2021.

Notwithstanding the above, those responsible for LPG transport units that have already complied with the obligations of the TUO GPS, may request their registration to OSINERGMIN at any time.
