On June 7, 2025, Law No. 32371 was published in the Official Gazette “El Peruano”, which allows the owners of State-owned rural properties, entirely used for agricultural activities, or of State-owned uncultivated lands with the same purpose, to regularize their situation before the regional governments, provided that such possession has been initiated until December 31, 2020.
In the case of rural properties, it is required that the possession has been public, peaceful and continuous. The regularization is not subject to any payment, except for the payment of the corresponding fees. On the other hand, the regularization of vacant land will be carried out by means of the direct award procedure, upon payment of the land’s tariff value.
The standard also establishes that the existence of pending or concluded judicial proceedings does not constitute an impediment for the regional governments to assume ownership for operational reasons and formalize the property in favor of the holders.
