Resolution of the National Water Authority regulating the payment of economic remuneration for the use of water and the discharge of treated wastewater

On February 25, 2020, the Administrative Resolution No. 057-2020-ANA which regulates the manner and terms for the payment of economic remuneration for the use of water and the discharge of treated wastewater was published in the Official Gazette El Peruano, rescinding the Administrative Resolution No. 083-2019-ANA.

Some of the most important aspects of the standard are the following: • The payment of the remuneration for the use of surface water for agricultural purposes derived from the water supply service is made to the hydraulic infrastructure operators by virtue of the single water bill. • The payment of the remuneration for the use of water for non-agricultural purposes of surface water, groundwater and users with their own water supply system, is based on the volume of water used during the previous year, volume resulting from consolidating the values recorded in the reports submitted by users through Format 6A (approved by the regulation). If the reports have not been submitted, they must, exceptionally, be submitted within the first 30 calendar days of the following year. Otherwise, the amount to be paid will be determined on the basis of the amount granted in the right to use water.

  • The payment of the remuneration for the use of water for energy purposes is based on the energy generated in the previous month, according to the monthly self-assessment made and the bill issued by the same user by electronic media, after obtaining the code, password and profile before the National Water Authority (“ANA”).
  • The payment of the remuneration for the use by users with authorizations for water use is made annually, depending on the volume used monthly.
  • The payment of the remuneration for discharge of treated wastewater is made annually, in advance and according to the volume of authorized discharge.
  • Requests for rectification of bill payment that seek to substantially alter their content and generate their cancellation must be submitted to the competent Local Water Administration within 30 calendar days from notification.
  • For users covered by Legislative Decree No. 1185, which regulates the special regime for monitoring and management of groundwater use by the EPS, the reason for revoking the right to use water for non-payment of two consecutive installments will be applied as of December 31, 2022, as long as the agreements signed by the EPS and the ANA for the automated transfer of remuneration are implemented.
  • The collection of economic remuneration from previous years that are pending payment or transfer must be carried out in accordance with the provisions of this regulation.
