On November 26, 2024, Ministerial Resolution No. 439-2024-MINEM/DM was issued, which ordered the publication of the Draft Regulation “Supreme Decree that approves the Regulation of Distributed Generation connected to Utilization Systems of the Users of the Public Electricity Service”.
This Normative Draft includes specific regulations applicable to the Public Electricity Service Users that have non-conventional renewable electricity generation or cogeneration equipment, whose surpluses may be injected to the distribution networks. It also establishes the requirements for the connection, installation, operation and commercialization of surpluses.
Among the most relevant provisions of this draft, we highlight that the maximum installed power of each Distributed Generator (regulated user) will be limited to the lower value between: (a) its contracted power with the distribution concessionaire (single connection) or the sum of the contracted powers (double or multiple connection) and (b) 10 kW (single-phase low voltage supplies) and 200 kW (three-phase low voltage supplies and medium voltage supplies). For distributed generation in isolated and rural systems, the power limit will be determined by the distribution concessionaire or the entity in charge of these functions, provided it is duly supported.
