ALERT – OIL AND GAS
Draft Supreme Decree that modifies the Regulations for the Distribution of Natural Gas through Pipeline Network and the Safety Regulations for Hydrocarbon Activities is published.
On October 4, 2024, Ministerial Resolution N° 378-2024-MINEM/DM (hereinafter, the “Resolution”) was published in the Official Gazette “El Peruano”, which ordered the publication of the draft Supreme Decree (hereinafter, the “Draft”) that amends the Natural Gas Distribution Regulation by Duct Network, approved by Supreme Decree N° 042-99-EM (hereinafter, the “Distribution Regulation”), and the Safety Regulation for Hydrocarbon Activities, approved by Supreme Decree N° 043-2007-EM (hereinafter, the “Safety Regulation”).
The Draft includes the following provisions:
- Modification of the Distribution Regulation and the Safety Regulation to implement an emergency report to be submitted within a maximum period of one (1) hour of the occurrence of the emergency.
- The Energy and Mining Investment Supervisory Agency (hereinafter, “OSINERGMIN”) shall implement in its Institutional Portal, the technological mechanisms and procedures for the reception, response and publication of the results of supervision of complaints related to Hydrocarbon Activities.
- OSINERGMIN shall publish every six months in its Institutional Portal, the results of supervision of the agents that carry out Hydrocarbon Activities (by operating unit). This publication shall not imply administrative responsibility, which shall be determined within an administrative sanctioning procedure.
- The agents that carry out Hydrocarbon Commercialization Activities must report the occurrence of emergencies in accordance with Article 26.3 (Preliminary Report within 24 hours of the occurrence of the emergency) and 26.4 (Final Emergency Report within 10 working days of the occurrence of the emergency) of the Safety Regulation.
A period of 15 calendar days from the day following the publication, which expires on October 19, 2024, has been established for comments, contributions or opinions to be received through the Ministry of Energy and Mines or by e-mail to prepublicaciones_DGH@minem.gob.pe.
