Ordinance that promotes social interest housing projects in the Constitutional Province of Callao is approved, granting urban benefits

On March 23, 2025, Ordinance N° 007-2025/MPC was published in the Official Gazette “El Peruano”, which promotes the execution of Social Interest Housing (“VIS”) in those areas of the Constitutional Province of Callao in which, due to its permissible and/or compatible use, this type of constructions can be developed.

The most important aspect of this regulation is that it includes urban development benefits provided for in the Regulation of Social Interest Housing, approved by Supreme Decree No. 006-2023-VIVIENDA, but which were declared null and void by the Constitutional Court.

In this way, the Provincial Municipality of Callao has taken an important step in promoting access to this type of housing in its jurisdiction, filling a gap that existed in the regulations.

The following are the most relevant points of the regulation:

  1. The Ordinance allows the implementation of VIS projects (multi-family, mixed-use buildings, residential complexes and mixed-use complexes) in those zones of the province of Callao where housing projects may be implemented, comprising the following zonings: Medium Density Residential Zone (RDM), Local Commerce (CL), Medium Density Mixed Zone (MDM), Other Uses (OU) [1], Medium High Density Residential Zone (RDMA), District Commerce (CD), Specialized Commerce (CE), Provincial Commerce (CP), Special Regulation Zones (ZRE)[2] and Monumental Zone (ZM)[3].
  2. The urban development benefits refer to the (i) buildability coefficient, (ii) density and (iii) maximum height, which were originally foreseen in the Social Interest Housing Regulation, although with some modifications:

For the purposes of the application of urban development benefits, the Ordinance includes a comparative table that allows for an equivalence between the zoning currently in force in the Constitutional Province of Callao and the zoning contained in the Regulation of Land Development and Urban Planning for Sustainable Development, as shown in the following table:

  1. Finally, the Ordinance provides that any omission or discrepancy between said regulation and the Social Housing Regulations shall be resolved by applying, preferably, the Social Housing Regulations. In other words, the national regulation will prevail, in application of the Principle of Unity.

[1] The urban development benefit only applies to housing programs executed under public bidding.
[2] Permissible or compatible projects in these zones are developed in accordance with the conditions established by the specific regulations approved by the Municipality.
[3] The corresponding regulations in force must be observed.
