Water Resources and Sanitation Alert
On August 20, 2024, Head Resolution No. 0323-2024-ANA was published, whereby two provisions of the Regulation for the Granting of Authorizations for Discharge and Reuse of Treated Wastewater, approved by Head Resolution No. 224-2013-ANA (the “Regulation”), are amended.
The amendments introduced to the Regulation are as follows:
- Regarding the procedure for the renewal of the authorization to discharge or reuse treated wastewater: Aligned with the objectives of administrative simplification, it is established that, in order to request the extension of the term, it must only be verified that (i) the request has been submitted before the expiration of the term of the authorization; and, (ii) that the conditions that gave rise to the granting of the authorization are maintained.
- Regarding the disposal of treated wastewater: It is specified that discharges of treated wastewater into drainage systems or dry creek beds will only be allowed if (i) they are contemplated in the corresponding environmental management instrument; and, (ii) provided that the dry creek or drain used to carry the treated wastewater is located in the area of direct influence of the project.
Finally, it is noted that the procedures for authorizations for discharge and reuse of treated wastewater that are in process will be adapted to the approved modifications, without this implying the backtracking of stages or the suspension of deadlines.
