On March 27, 2025, Supreme Decree N° 004-2025-MTC was published in the Official Gazette “El Peruano”, which approved the Regulation of Legislative Decree N° 1627 (the “Regulation”). The purpose of the latter was to promote the deployment of public telecommunications services using fifth generation (5G) or higher technology.
The Regulation regulates the procedure by which the special mechanism for granting concessions with assignment of radio spectrum for the use of 5G technology is carried out, including its procedural phases, the determination of the assigned spectrum and the frequency auction mechanism, among others. In that sense, it contains the legal, technical and economic-financial requirements that interested companies must comply with in order to access the special assignment mechanism.
The Regulation also regulates the procedure for existing concessionaires to voluntarily access the refarming of spectrum bands where there are already assignments. In addition, it repealed the Supreme Decree that approved the spectrum cap for the 3400-3600 MHz band.
