SBS Regulations
The Superintendence of Banking, Insurance, and Private Pension Fund Administrators (“SBS”) amends the Regulations on Infractions and Sanctions, approved by SBS Resolution No. 2755-2018
Pursuant to SBS Resolution No. 1029-2026, published in the Official Gazette El Peruano on April 10, 2026, the SBS amended the aforementioned regulations in the following aspects related to supervised entities of the financial system:
- Failure to protect the company’s information assets against information security incidents is classified as a serious infringement when it does not result in the loss, misappropriation, or alteration of clients’ confidential information; and as a very serious infringement when such loss, misappropriation, or alteration does occur.
- Failure to comply with the applicable regulatory framework regarding the application of installment advances and/or prepayments is classified as a minor infringement; as a serious infringement when such conduct results in harm to users equal to or exceeding 20 UIT; and as a very serious infringement when the harm is equal to or exceeds 100 UIT.
- Failure to comply with the applicable regulatory framework regarding the application of the order of allocation of payments in credit card obligations and/or other active products is classified as a minor infringement; as a serious infringement when such conduct results in harm to users equal to or exceeding 20 UIT; and as a very serious infringement when the harm is equal to or exceeds 100 UIT.
- Failure to publish on the website information related to complaints, contractual forms, summary sheets, as well as products and/or services is classified as a minor infringement.
- Serious and very serious infringements related to the failure to execute and/or apply agreed contractual terms, as provided for under the applicable regulations, are repealed.
The SBS updates the minimum share capital of supervised entities for the April–June 2026 quarter. Pursuant to Circular Resolution No. G-232-2026, published in the Official Gazette El Peruano on April 10, 2026, the SBS ordered the quarterly update, corresponding to the April–June 2026 period, of the minimum share capital of the entities referred to in Articles 16 and 17 of the General Law of the Financial System and the Insurance System and Organic Law of the Superintendence of Banking and Insurance, Law No. 26702.
In the case of entities within the financial system, the updated amounts (in Soles) are as follows:

1) SBS authorizes the publication of the draft Regulations on the Capital Adequacy Management Process of Financial System Entities.
By notice dated April 30, 2026, the SBS authorized the publication of the aforementioned draft.
2) SBS authorizes the publication of the draft new Regulations for Debtor Evaluation and Classification and the Requirement of Provisions.
By notice dated April 29, 2026, the SBS authorized the publication of the aforementioned draft.
3) SBS authorizes the publication of the draft amendments to the Regulations on Capital Requirements for Credit Risk.
By notice dated April 29, 2026, the SBS authorized the publication of the aforementioned draft.
4) SBS authorizes the publication of the draft amendments to the Accounting Manual for Financial System Entities, the Accounting Manual for Pension Fund Administrators (AFPs), and the Chart of Accounts for Insurance System Entities.
