Developments in the Application of the Legal Regime for Corporate Criminal Liability
The Superintendencia del Mercado de Valores (SMV) recently announced that it had received a request from the Public Prosecutor's Office (Fiscalía) to issue an opinion on the effectiveness of a company's crime prevention model (MPD), in connection with an investigation into the alleged commission of the crime of money laundering. As part of this investigation, the company has submitted its MPD, invoking the exempting and/or mitigating effects granted under Law 30424, provided that it constitutes an MPD duly implemented within the corporate organization.
