Modification of the Regulations for the Commercialization of Liquid Fuels and OPDH, and Rules on the Mass Consumption of Natural Gas
On September 25, 2024, Supreme Decree N° 017-2024-EM (the “Supreme Decree”) was published in the Official Gazette “El Peruano”, which amended the Regulations for the Commercialization of Liquid Fuels and Other Products Derived from Hydrocarbons, approved by Supreme Decree N° 045-2001-EM (the “Regulations”), and amended Article 13 of Supreme Decree N° 063-2005-EM, which issued rules to promote the massive consumption of natural gas.
The main aspects of the Supreme Decree are as follows:
- Modification of the Regulation by incorporating Article 43-A, which establishes the obligation of OSINERGMIN to report to the General Directorate of Hydrocarbons of the Ministry of Energy and Mines, the daily volumes of liquid fuel stocks by obligated agent, fuel and operating unit, and any situation that jeopardizes the supply of liquid fuels; as well as, as required, the actions of supervision of compliance with the obligation to maintain liquid fuel stocks.
- Modification of Article 13 of Supreme Decree N° 063-2005-EM, which issued rules that promote the massive consumption of natural gas, in order to broaden the scope of the “Authorization to conduct tests” procedure, for the evaluation of the viability of projects that use all types of hydrocarbons and hydrogen, and whose purpose is to ensure the country's energy supply and/or increase the access to efficient energies.
