On April 2, 2025, Supreme Decree N° 005-2025-MTC was published in the Official Gazette “El Peruano”, which approved the Regulation of Legislative Decree N° 1599 (the “Regulation”). The purpose of the latter was to promote technological innovation through the temporary relaxation or exemption of the obligations established in the telecommunications regulations.
The conditions referred to include, for example, (i) the existence of identifiable potential benefits, direct or indirect, for the population; (ii) the existence of uncertainty as to whether its execution complies with the regulation in force; and (iii) the existence of an owner willing to execute it through an implementation plan subject to objectives, and with resources for its execution, among others.
Finally, the Regulation regulates the detailed procedure for the application of the regulatory flexibilization, including rules for the call and presentation of applications, and the existence of a special regime for the payment of the commercial exploitation fee and contribution to FITEL.
